Regarding this issue, LawNet would like to answer as follows:

1. Health insurance payment methods are under the management of the Ministry of National Defense in Vietnam

According to Article 5 of Circular 143/2020/TT-BQP, the methods of health insurance payment under the management of the Ministry of National Defense in Vietnam are as follows:

(1) For the subjects specified in Clause 1, Article 1 of Circular 143/2020/TT-BQP.

- Monthly, the unit pays health insurance premiums for employees and deducts health insurance premiums from the employee's salary according to the payment rate specified at Point a, Clause 1, Article 3 of Circular 143/2020/TT-BQP to submit at the same time, no later than the last day of the month on Social Insurance of the Ministry of Defense.

- For the case specified at Point b, Clause 1, Article 3 of Circular 143/2020/TT-BQP, when the competent authority concludes that there is no violation of the law, the employer shall deduct the employee's medical insurance arrears equal to 4.5% of 50% of the employee's total salary during detention, custody, or temporary suspension from work for investigation and submit them to the Social Insurance Ministry of National Defense.

(2) For the subjects specified in Clause 2, Article 1 of Circular 143/2020/TT-BQP.

- Subjects specified at Points a, b, Clause 2, Article 1 of Circular 143/2020/TT-BQP:

+ Every year, the Social Insurance Ministry of National Defense shall sign payment contracts and issue health insurance cards to the units directly managing this subject.

+ The unit directly managing the subjects that deduct health insurance premiums from the state budget according to the payment rates specified in Clause 2, Article 3 of Circular 143/2020/TT-BQP to pay into the health insurance collection account of the Social Insurance Ministry of National Defense as soon as the contract takes effect, the health insurance premium from the effective date of the contract to the end of December 31 of the fiscal year, and liquidate the contract in accordance with regulations.

- Subjects specified at point c, point d, Article 1 of Circular 143/2020/TT-BQP:

+ Every year, before October 31, a unit affiliated with the Ministry of National Defense signs a contract with the Social Insurance Department of the Ministry of Defense to pay health insurance premiums and issue health insurance cards to these subjects.

+ Based on the signed contract and the decentralized state budget, the unit shall pay health insurance premiums to the health insurance collection account of the Social Insurance of the Ministry of National Defense according to the payment rate specified in Clause 2, Article 3 of Circular 143/2020/TT-BQP in 2 installments:

(i) The first installment, within 30 days from the effective date of the contract and at least equal to 85% of the total value of the contract;

(ii) Phase 2, before October 31 of each year, the two parties compare the issued card numbers, the amount to pay health insurance premiums (including an increase or decrease in the number of people participating in health insurance or due to an adjustment of the base salary or health insurance premium) to transfer the amount to be paid and liquidate the contract as prescribed.

- Entities paid by the state budget shall transfer funds to the health insurance fund according to the provisions of Clause 9 Article 9 of Decree 146/2018/ND-CP.

(3) For the subjects specified in Clause 3, Article 1 of Circular 143/2020/TT-BQP:

- Every year, the Social Insurance Ministry of National Defense signs a contract to pay health insurance premiums and issue health insurance cards to the units directly managing the subjects.

- Immediately after the contract takes effect, the unit collects health insurance premiums. Part of the responsibility for payment of students is determined according to the payment rate specified in Clause 3, Article 3 and the level of support from the state budget specified in Article 4 of Circular 143/2020/TT-BQP. According to the term of the school year if the study is long-term for more than 1 year or according to the course if the study is full for 12 months or less, it shall be paid into the health insurance collection account of the Ministry of National Defense Social Insurance.

- After the annual settlement, the Ministry of Defense Social Insurance summarizes the number of health insurance cards issued, the amount actually collected from students, and the amount supported by the state budget according to the provisions of Article 4 of Circular 143/2020/TT-BQP, reports it to Vietnam Social Insurance, and sends it to the Ministry of Finance to transfer the health insurance premium to the Ministry of National Defense's social insurance contributions.

- For subjects with 100% state budget support of health insurance premiums, when the state adjusts health insurance premiums or base salaries, the amount of state budget support payment will be adjusted from the date of application of the new health insurance premium and the new base salary.

- For subjects who are partially supported by the state budget for health insurance premiums, when the state adjusts the health insurance premiums or the base salary, the students and the state budget are not required to additionally pay the difference due to the adjustment of the health insurance premium rate, the base salary for the remaining time that the student has paid health insurance premiums.

(4) For the subjects specified in Clause 4, Article 1 of Circular 143/2020/TT-BQP, the employer pays health insurance premiums for this subject together with the payment of health insurance premiums for employees from the sources specified in Clause 4, Article 3 of Circular 143/2020/TT-BQP.

2. Who shall not apply for health insurance under the management of the Ministry of National Defense in Vietnam?

According to Article 2 of Circular 143/2020/TT-BQP, those who do not apply for health insurance under the management of the Ministry of National Defense are as follows:

- Subjects specified at Points a, b and c, Clause 1, Points c and d, Clause 2, Clause 4, Article 1 of Circular 143/2020/TT-BQP while living, studying, or working abroad for a definite time.

- The subjects specified at Points c, d, Clause 2 and Clause 4, Article 1 of Circular 143/2020/TT-BQP are participating in health insurance according to the groups of subjects specified in Clause 1; Points a, b, c, d, dd, e, g, h, i and k, Clause 3, Article 12 of the Law on Health Insurance 2008 (amended 2014).

- Relatives of people working in cipher organizations working in other ministries, branches, and localities shall comply with the provisions of Decree 146/2018/ND-CP and documents issued by the Ministry of Health and Social Insurance of Vietnam.
