Contents of guidance in Decision 20/2022/QD-UBND on Regulations on inter-sectoral coordination in handling the registration of domestic adoptions and adoptions involving foreign elements in Ho Chi Minh City.
According to Decision 20/2022/QD-UBND, the settlement of domestic adoption of children residing in wards, communes, and towns is as follows:
Settlement for domestic people to adopt abandoned children
- Abandoned children have been assigned by the People's Committees of wards, communes, or townships to people who are temporarily taking care of them. If the temporary foster or surrogate caregiver wishes to adopt the child and is eligible for adoption, the People's Committees of wards, communes, and townships shall consider and settle the adoption according to law provisions.
- In case the person who temporarily takes care of the child is no longer able to care for the child or does not wish to continue to take care of the child,
The People's Committee of the ward, commune, or township shall make a dossier of request for transfer of the child to a social assistance establishment according to the provisions of Clause 4, Article 27, Clause 3, Article 28 of Decree 20/2021/ND-CP.
Finding people in the country to adopt children subject to social protection in extremely difficult circumstances and in urgent need of protection.
People's Committees of wards, communes, and townships where children subject to social protection are living in extremely difficult circumstances and children in urgent need of urgent protection without a foster parent are responsible for supporting the care and rearing of the child and shall notify and post it up at the headquarters of the People's Committee within 60 days to find people in the country to adopt the child.
During the time of notification and posting, if someone residing in the City adopts a child, the People's Committees of wards, communes, and townships shall consider and process adoption registration in accordance with law.
If there is no resident in the City to adopt the child, the People's Committee of the ward, commune, or township shall make a dossier for sending the child to a social assistance establishment according to the provisions of Clause 4, Article 27, Clause 3, Article 28 of Decree 20/2021/ND-CP.
Review and assess the needs of children who need to be adopted and are temporarily fostered or cared for by residents in wards, communes, or townships.
Every month, the People's Committees of wards, communes, and townships review and evaluate children being temporarily fostered or cared for by people in the locality to consider, settle, or guide adoption. .
After reviewing and assessing if there are no residents in the city to adopt children, the People's Committees of wards, communes, and townships make a dossier on sending the children to social assistance establishments. A written request for placement of a child in a social assistance facility, issued by the People's Committee of the ward, commune, or township, must contain a confirmation that there is no one to adopt the child.
