Regarding this issue, LawNet would like to answer as follows:

1. Hardship allowance for relatives of non-commissioned officers and police servicemen in Vietnam

According to Article 3 of Decree 05/2016/ND-CP, the hardship allowance regime for relatives of non-commissioned officers and soldiers on public service duty is as follows:

- Relatives of non-commissioned officers and soldiers who are sick for 01 month or more or treated once at the hospital for 07 days or more are entitled to an allowance of 500,000 VND/rate/time.

- Families of non-commissioned officers and soldiers who have an accident, fire, or natural disaster resulting in their house collapsing, drifting, burning, or having to relocate are entitled to a subsidy of 3,000,000 VND/person/time.

The regimes specified in Clauses 1 and 2, Article 3 of Decree 05/2016/ND-CP shall be applied not more than 02 times in 01 year for one subject.

- Relatives of non-commissioned officers and soldiers who have died or gone missing are entitled to an allowance of 2,000,000 VND/person.

2. Procedures for granting hardship allowance to relatives of non-commissioned officers and soldiers of the People's Public Security Forces in Vietnam

Pursuant to Article 4 of Decree 05/2016/ND-CP, the application procedure, responsibilities, and order of implementation of the hardship allowance regime are as follows:

- Dossier for consideration of benefits

+ Declaration of request for unexpected hardship allowance of non-commissioned officers and soldiers according to the Appendix attached to Decree 05/2016/ND-CP and the following papers:

++ Hospital discharge certificate or certificate of hospital of district or higher level, where relatives of non-commissioned officers and soldiers are being treated, for the cases specified in Clause 1, Article 3 of Decree 05/2016/ND-CP;

++ A certificate of the People's Committee of the commune, for the case specified in Clause 2, Article 3 of Decree 05/2016/ND-CP;

++ Death certificate or certificate of relatives of missing non-commissioned officers or soldiers, issued by a competent authority, for the cases specified in Clause 3, Article 3, of Decree 05/2016/ND-CP.

APPENDIX

+ A written request for an unexpected hardship allowance from the unit directly managing non-commissioned officers and soldiers at the battalion or department level, district, town, or city directly under the province, and the equivalent or higher.

- Responsibilities and order of implementation

+ For non-commissioned officers and soldiers

++ Making a declaration requesting an hardship allowance according to the provisions of Point a, Clause 1, Article 4 of Decree 05/2016/ND-CP;

++ Submitting declarations and relevant papers to the unit directly managing non-commissioned officers and soldiers.

+ For the People's Committee of commune

Within 07 working days after receiving the request for certification, the commune-level People's Committee is responsible for inspecting and certifying the cases specified in Clause 2, Article 3 of Decree 05/2016/ND-CP.

+ For units directly managing non-commissioned officers and soldiers

++ Receiving declarations and papers submitted by non-commissioned officers and soldiers;

++ Within 03 working days from the date of receipt of complete dossiers, synthesize, examine and request competent superiors (Department level; Police, Fire Prevention and Fighting Police of provinces and centrally run cities; Prisons and equivalents under the General Department of Police for criminal judgment execution and judicial assistance; Regiment level under the Mobile Police Command (collectively referred to as Police units and localities) to consider and decide on unexpected hardship allowances for non-commissioned officers and soldiers;

++ Paying unexpected hardship allowances for non-commissioned officers and soldiers upon decision of competent authorities.

+ For the unit and local police

Within 07 working days after receiving a complete dossier, the police unit of the unit or locality where the non-commissioned officer or soldier is working shall complete the consideration and decision on unexpected hardship allowance. In case of ineligibility, must reply in writing and clearly state the reason.
