Regarding Mr. Linh's matter, the Lawnet Editorial Board provides the following response:
According to Clause 3, Article 4 of Circular 148/2018/TT-BQP regulating the selection and conscription of citizens to perform military service, health requirements for enlistees are specified as follows:
Article 4. Recruitment standards
...
3. Health standards:
a) Selecting citizens with health Types 1, 2, and 3 as per the provisions in Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016 by the Minister of Health and the Minister of National Defense, regulating pre-enlistment medical check-up.
b) For agencies, units, and positions specified in Point b, Clause 2 of this Article, recruitment must meet specific standards as stipulated by the Ministry of National Defense.
c) Citizens with health Type 3 and refractive eye disorders (nearsightedness of 1.5 diopters or more, farsightedness of various degrees); drug addiction, HIV, and AIDS are not conscripted into the military.
Additionally, Joint Circular 16/2016/TTLT-BYT-BQP clearly outlines the method of health classification in Clause 4, Article 9, as follows:
4. Health classification method
Based on the scores for 8 criteria recorded in the military service health examination form to classify health. Specifically:
a) Type 1: All 8 criteria score 1;
b) Type 2: At least 1 criterion scores 2;
c) Type 3: At least 1 criterion scores 3;
d) Type 4: At least 1 criterion scores 4;
đ) Type 5: At least 1 criterion scores 5;
e) Type 6: At least 1 criterion scores 6.
Thus, to participate in military service, Vietnamese citizens must not have any health criteria classified as Type 4. Based on the above, Lawnet compiles a list of dental diseases ineligible for military service as follows:
