Hanoi-Vietnam: Allowing primary school graduates to act as neighborhood security officers from July 1, 2024

Vietnamese citizens who wish to act as neighborhood security officers must meet the standards and conditions according to regulations. Among these, primary school graduates can act as neighborhood security officers.

1. What is the neighborhood security force?

Neighborhood security can be understood as a term for the force that participates in protecting security and order at the grassroots level.

This force is established by the local government voluntarily of the people to support the Commune, Ward, Township Police (hereinafter referred to as Commune-level Police) in helping the same-level People's Committee to protect security and order and build the movement of all people to protect national security.

This is one of the mass forces, arranged in neighborhoods and residential groups, playing a core role in supporting the Commune-level Police to help the same-level People's Committee protect security, and order, and build the movement of all people to protect national security.

2. The case where primary school graduates are allowed to act as neighborhood security officers from July 1, 2024

According to Article 13 of the Law on Participation in Force Protecting Security and Order at the Grassroots Level 2023, Vietnamese citizens who aspire and meet the following standards and conditions are considered for selection to participate in the force protecting security and order at the grassroots level:

  • Being from 18 years old to 70 years old; in the case of over 70 years old, if health is guaranteed, the Chairman of the Commune-level People's Committee may consider and decide based on the recommendation of the Commune-level Police;

  • Having a clear background; good moral character; self and family adhering well to the policies of the CPV, and laws of the State; not being investigated for criminal responsibility, not serving criminal sentences in communes, wards, townships, executing judicial measures or administrative handling measures. In the case of having completed the Court’s sentence, the criminal record must be expunged; having completed the decision on administrative handling measures, the designated period must pass for no longer being considered as having applied administrative handling measures according to the law;

  • Having a diploma or having completed secondary education or higher. For border, island areas, mountainous regions, socio-economic special difficulty areas, ethnic minority areas, those who have completed primary education can be selected;

  • Permanently or temporarily residing for 01 year or more and regularly living in the place where the citizen applies to participate in the force protecting security, order at the grassroots level.

In the case specified in Clause 3, Article 15 of the Law on Participation in Force Protecting Security and Order at the Grassroots Level 2023, they must be permanently or temporarily residing in the place where they apply to participate in the force protecting security, order at the grassroots level;

  • Having sufficient health according to a certificate from a medical facility established and operating according to the law.

Thus, according to the above provisions, for border, island areas, mountainous regions, socio-economic special difficulty areas, and ethnic minority areas, those who have completed primary education can be selected.

3. Commune-level police will direct and administer the neighborhood security force from July 1, 2024

UInder Clause 1, Article 5 of the Law on Participation in Force Protecting Security and Order at the Grassroots Level 2023, the working relationship of the force participating in protecting security and order at the grassroots level is regulated as follows:

  • The Commune-level People's Committee manages the organization and activities of the force participating in protecting security and order at the grassroots level;

  • Commune-level Police assist the same-level People's Committee in directly managing the organization, and operational activities, directing, and governing the force participating in protecting security and order at the grassroots level; guide, assign, and inspect the task performance of the force participating in protecting security and order at the grassroots level;

  • The relationship between the force participating in protecting security and order at the grassroots level with the grassroots mass organizations is a relationship of coordination in performing the task of protecting security, and order, and building the movement of all people protecting national security.

Thus, the commune-level police directly manage the organization and activities, and direct, and administer the neighborhood security force.
