Cases in which officials are considered for promotion in Vietnam (Latest)

According to Clause 1, Article 31 of Decree 138/2020/ND-CP (amended by Decree 116/2024/ND-CP), officials are considered for promotion in Vietnam in the following cases:

- Meeting the standards and conditions specified at points a, b, and c of Clause 3, Article 30 of Decree 138/2020/ND-CP (amended by Decree 116/2024/ND-CP) and having achievements in public service activities recognized by a competent authority;

- Meeting the standards and conditions specified at points a, b, and c of Clause 3, Article 30 of Decree 138/2020/ND-CP (amended by Decree 116/2024/ND-CP) and being appointed to leadership or management positions specified in Article 31b of Decree 138/2020/ND-CP (supplemented by Decree 116/2024/ND-CP).

Guidance on Promotion Consideration when Appointed to Leadership and Management Positions

Promotion consideration when appointed to leadership and management positions shall be implemented according to Article 31b of Decree 138/2020/ND-CP (supplemented by Decree 116/2024/ND-CP), specifically:

- Promotion consideration to Senior Specialist or equivalent when appointed to the following positions and titles:

+ Director General and equivalent or higher in Ministries, ministerial-level agencies, agencies under the Government of Vietnam (applicable for those identified as officials);

+ Deputy Director General and equivalent or higher in Ministries, ministerial-level agencies;

+ Director and equivalent in General Departments under Ministries, ministerial-level agencies for cases of promotion consideration to specialized ranks other than Senior Specialist rank;

+ Director of Departments and equivalent or higher in provincial People's Committees.

- Promotion consideration to Principal Specialist or equivalent when appointed to the following positions and titles:

+ Deputy Director General and equivalent in Ministries, ministerial-level agencies, agencies under the Government of Vietnam (applicable for those identified as officials);

+ Director General and equivalent in General Departments under Ministries, ministerial-level agencies, except for cases specified at point c, Clause 1, Article 31b of Decree 138/2020/ND-CP (supplemented by Decree 116/2024/ND-CP);

+ Deputy Director and equivalent in General Departments under Ministries, ministerial-level agencies for cases of promotion consideration to specialized ranks other than Principal Specialist rank;

+ Deputy Director of Departments and equivalent in provincial People's Committees; Chairman of district-level People's Committees and equivalent.

- For equivalent positions and titles in agencies of People's Councils, agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, and socio-political organizations, the regulations specified in Article 31b of Decree 138/2020/ND-CP (supplemented by Decree 116/2024/ND-CP) shall apply.

Promotion consideration as per Article 31b of Decree 138/2020/ND-CP (supplemented by Decree 116/2024/ND-CP) does not apply to those assigned to act on behalf or are in charge of agencies, organizations, or units.

Principles for Promotion Consideration for Officials in Vietnam from September 17, 2024

Promotion consideration for officials in Vietnam from September 17, 2024, must comply with the principles specified in Clause 2, Article 31 of Decree 138/2020/ND-CP (amended by Decree 116/2024/ND-CP). To be specific:

- Promotion consideration is only performed to the next immediate higher rank from the current rank. In cases of higher achievements than those required for promotion to the next rank, promotion consideration is only granted to the next immediate rank, and such achievements will not be used for future promotion considerations.

- Promotion consideration for officials with achievements in public service must comply with the structure of the ranks used by the employing agency, approved by the competent authority; achievements must be obtained during the time holding the current official rank and ensure officials are assigned work matching the position or title of the rank considered for promotion.

- Promotion consideration for officials appointed to leadership or management positions must match the requirements of the work position approved by the competent authority managing officials.
