Regarding this issue, LawNet would like to answer as follows:

1. Group of health insurance policyholders whose contributions are paid by employees in Vietnam

Group of health insurance policyholders whose contributions are paid by employees according to Article 6 of Decree 146/2018/ND-CP as follows:

- Relatives of public national defense workers and employees on active service in the military, including those defined in point a, b and c, clause 13, Article 3 of Decree 146/2018/ND-CP:

+ Natural parents; natural parents-in-law; legal caregivers of selves and spouses;

+ Spouses;

+ Natural children or legally adopted children aged from 6 years to under 18 years; natural children and legally adopted children aged 18 years or older if they are still taking formal education.

- Relatives of public security workers on active service in the People’s Police, including those defined in point a, b and c, clause 13, Article 3 of Decree 146/2018/ND-CP:

+ Natural parents; natural parents-in-law; legal caregivers of selves and spouses;

+ Spouses;

+ Natural children or legally adopted children aged from 6 years to under 18 years; natural children and legally adopted children aged 18 years or older if they are still taking formal education.

- Relatives of those performing other tasks in cryptographic organizations, including those defined in point a, b and c, clause 13, Article 3 of Decree 146/2018/ND-CP:

+ Natural parents; natural parents-in-law; legal caregivers of selves and spouses;

+ Spouses;

+ Natural children or legally adopted children aged from 6 years to under 18 years; natural children and legally adopted children aged 18 years or older if they are still taking formal education.

2. Method of paying health insurance contributions paid by employers in Vietnam

According to Clause 8, Article 9 of Decree 146/2018/ND-CP is as follows:

With respect to health insurance policyholders referred to in Section 1, on a monthly basis, employers shall make health insurance contribution payments for them and pay health insurance contributions for their employees in accordance with regulations in force by using the following funding sources:

- If these employees work for state budget-financed units, state budget allocations shall support health insurance contributions of these policyholders;

- If these employees work for public service units, their health insurance contributions shall be paid by each unit’s budget in accordance with laws on autonomy mechanisms of public service units;

- If these employees work for enterprises, their health insurance contributions shall be paid by each enterprise’s budget.

3. Health insurance premiums for groups are paid by the employer in Vietnam

According to Clause 4, Article 7 of Decree 146/2018/ND-CP stipulating  In case where health insurance policyholders specified in Article 6 hereof and those specified in Article 1, 2, 3 and 4 hereof overlap, health insurance contributions shall be paid in the following order: Health insurance contributions are paid:

- Paid by employees and employers;

- Paid by the social insurance agencies;

- Paid by the state budget;

- Paid by the employers.

4. Prohibited acts in the field of health insurance in Vietnam

Prohibited acts in the field of health insurance under Article 11 of the Law on Health Insurance 2008 are as follows:

- Failing to pay or fully pay health insurance premiums under the Law on Health Insurance 2008.

- Committing fraud related to or forging health insurance files or cards.

- Using collected health insurance premiums or the health insurance fund for improper purposes.

- Obstructing, troubling or causing harms to the insured and parties involved in health insurance in the exercise of their lawful rights and enjoyment of their benefits.

- Deliberately making false reports or providing false information and data on health insurance.

- Abusing one’s position, power or professional operations to act in contravention of the health insurance law.
