Pursuant to the provisions of Article 3 of Decree 138/2020/ND-CP, the recruitment of civil servants must be based on task requirements, employment positions, and payroll quotas.
The agency competent to recruit civil servants shall develop a recruitment plan and report it to the civil servant management agency for approval as a basis for recruitment before each recruitment period. The contents of the recruitment plan include:
- Number of civil servant payrolls assigned by competent authorities and unused payrolls of agencies employing civil servants;
- Number of staff to be recruited for each job position;
- Number of job vacancies to be recruited for ethnic minorities (if any), in which clearly defined criteria and ethnic structure are to be recruited;
- Number of job positions to be recruited (if any) for each target group: People who commit to volunteering to work for 5 years or more in areas with extremely difficult socio-economic conditions; learners according to the recruitment regime according to the provisions of the Law on Education, after graduating to work in the locality where they are sent to study; excellent graduates, talented young scientists;
- Standards and conditions for registration for each job position;
- Form and content of the entrance examination or examination;
- Other contents (if any).
The recruitment plan when applying for the group of excellent graduates and talented young scientists to implement according to the Government's regulations on the policy of attracting and creating cadres from excellent graduates and young scientists.
Grounds for annual recruitment of civil servants in Vietnam (Internet image)
Pursuant to Clause 1, Article 36 of the Law on Cadres and Civil Servants 2008, a person who meets all the following conditions, regardless of nationality, gender, social status, belief and religion, may register for civil servant recruitment:
(1) Bearing the sole nationality of Vietnamese;
(2) Reaching full 18 years of age;
(3) Filing an application for recruitment; having a clear personal record;
(4) Possessing relevant diplomas and/or certificates;
(5) Possessing political qualities and good ethics:
(6) Being physically fit for the job;
(7) Meeting other conditions required by the working position for which he/she applies.
The following persons may not register for civil servant recruitment:
- Not residing in Vietnam;
- Having lost civil act capacity or having such capacity restricted;
- Being examined for penal liability; currently serving a criminal sentence or court ruling or having completely served such a sentence or ruling but such criminal record has not yet been remitted, or serving the administrative measure of confinement to a medical treatment establishment or a reformatory.
Note: The agency employing civil servants determines other conditions as required by the candidate position, in accordance with the job position competency framework, training must not be lower than the general standards, must not be contrary to the provisions of the law, and must not discriminate against the type of training. A report must be submitted in writing for the management agency to consider and decide.
