What are the general regulations on commendation for dedication in Vietnam? - Hoang Nha (Binh Thuan)
Pursuant to Article 6 of Decree 98/2023/ND-CP, general regulations on commendation for dedication in Vietnam are as follows:
- Cadres participating in revolutionary activities before 1945 are those who participated in the revolution before January 1, 1945; people admitted to the Indochina Communist Party or re-admitted before August 19, 1945, recognized by competent authorities;
- Pre-uprising officers are those who participated in the revolution from January 1, 1945, to the August uprising in 1945 and were recognized by competent authorities;
- Cadres who participated in the revolution continuously in the two resistance wars against the French colonialists and against the US imperialists were those who participated in the revolution continuously from the date of the August uprising in 1945 to April 30, 1975;
- Cadres active in the resistance war against the French colonialists are those who have continuously participated in the revolution during the period from the August uprising in 1945 to July 20, 1954;
- Cadres active in the resistance war against US imperialism are those who continuously participated in the revolution in the period after July 20, 1954, to April 30, 1975;
- A person who operates continuously in the southern battlefield is a person who has operated continuously for at least 10 years in the southern, Laos, and Cambodian battlefields. In cases of continuous operation on the battlefield before 1960, the period of continuous operation is until January 1973. In the case of entering the battlefield since 1964, the period of continuous operation is until April 30, 1975;
- Officials working during the period of building and protecting the Fatherland are those who participated in the revolution after April 30, 1975.

- Ministries, departments, branches, and provinces submit to the Prime Minister for consideration and submit to the President to reward contributions to individuals who meet the conditions and standards when there is a notice of retirement or a decision to retire without being rewarded for contributions (including cases of sacrifice or death). In cases where an individual has been rewarded for his or her dedication, then continues to work and holds a leadership or management position for a period of time and he or she is eligible to be rewarded for his or her dedication, they will continue to be considered for commendation for the dedication process for the working period, holding positions in the future working period, and be recommended for emulation titles and other forms of reward according to regulations if conditions and standards are met;
- For individuals who have time holding a position but do not have enough time to be rewarded according to the standards prescribed for that position, that time will be added to the time spent holding the adjacent lower position to calculate the reward standards according to the adjacent lower position (if that adjacent position belongs to the standards for rewarding the dedication process);
- Individuals who hold many different positions at the same time will use the highest position as the basis for applying reward standards;
- An individual who requests a transfer, transfer, or organizational arrangement is decided by a competent authority and holds a lower position than before the transfer, transfer, or organizational arrangement when considering rewards, the position taken before rotation, mobilization, or organizational arrangement and the time continuously calculated according to that position will be used as a basis for considering rewards;
- In cases where the process of dedication has been rewarded, reward adjustments will not be made according to the new regulations on equivalent titles. In cases where the process of dedication has not been rewarded, compare the regulations; if the right person meets the conditions and standards, then request consideration for commendation of the process of dedication.
- Do not reward individuals who are expelled from the Party or disciplined in the form of forced resignation; stripped of the title of soldier, people's police officer, or professional military rank. For individuals who have been disciplined and expelled from the Party, then have corrected their shortcomings, strived, and been re-admitted to the Party, if they meet the prescribed standards, their time and position after joining the Party will be considered for reward next time;
- Lower a level of commendation for individuals who have been disciplinaryly expelled from the Party and then re-admitted; individuals: dismissed, demoted, demoted in rank, military rank, reduced salary, reprimanded, warned. Discipline is only considered once for a form of reward (subsequent commendation reviews are not based on the previous disciplinary form of reward).
Note: The Ministry of Home Affairs asks for opinions from the Central Organizing Committee and Central Inspection Committee for officials managed by the Politburo and the Secretariat before submitting to the Prime Minister for consideration and submitting to the President for commendation.
