Regarding this issue, LawNet would like to answer as follows:

1. What is military and civilian hospital?

According to Point a, Clause 1, Article 4 of Circular 34/2019/TT-BYT, military and civilian hospitals are public health service units directly under units managed by the military. For the Military and Civilian Hospital, it is organized on the basis of a district hospital in coordination with the military medical force in the area, which is a public health service unit under the Department of Health;

2. Functions and tasks of military and civil medical hospitals in Vietnam

Because the military and civil medical hospital is one of the forms of military and civil medical examination and treatment facilities, it will have the functions and tasks of this facility, specifically:

- Organize first aid, transportation, medical examination and treatment for people and soldiers in the area within the scope of expertise approved by competent authorities;

- Organize disease prevention and propagate disease prevention hygiene to people and soldiers in the area;

- Organize forces and be ready to mobilize all or part of the unit's resources to organize first aid, transport, admission, and treatment of patients in natural disasters and catastrophes and situations with mass casualties;

- Organize training, professional training, and foster knowledge of military medicine and disaster medicine for medical staff in the area;

- Periodically or irregularly organize medical examination and treatment for policy beneficiaries; Participate in mass mobilization and foreign affairs work in border areas and islands;

- Participate in implementing health programs according to tasks assigned by competent authorities;

- Carry out statistical and reporting work according to regulations;

- Other tasks assigned by competent authorities according to the provisions of the law.

3. Authority to establish military and civilian medical examination and treatment facilities in Vietnam

Specifically, Article 3 of Circular 34/2019/TT-BYT stipulates the authority to establish military and civilian medical examination and treatment facilities as follows:

- The Minister of National Defense decides on the establishment, reorganization, or dissolution after obtaining written consent from the People's Committee of the province or centrally run city where the unit is stationed in the form of military and civilian medical clinics.

Military and civilian medical clinic is a medical facility affiliated with military units at the regimental level or equivalent or higher, directly managed administratively by the Head of the Army unit, and directly professionally managed by the superior military medical agency;

- The Chairman of the Provincial People's Committee shall decide on the establishment, reorganization, or dissolution after obtaining written consent from the Ministry of National Defense and the Ministry of Health for the following forms:

+ Military and Civilian Medical Center;

+ Civilian military medical station.

(i) The Military and Civilian Medical Center is a public health service unit under the Department of Health;

(ii) The military and civilian medical station is a public medical facility directly under the district medical center, organized on the basis of the commune medical station in coordination with the military medical force in the area.

- Military and civilian medical examination and treatment facilities may only operate after being granted an operating license by a competent authority in accordance with the law on medical examination and treatment.

4. Organizational form and criteria for establishing military and civilian medical examination and treatment facilities in Vietnam

The organizational form and criteria for establishing military and civilian medical examination and treatment facilities are prescribed as follows:

(i) Military and civil medical hospitals: only applicable to military and civil medical hospitals that have been established by competent authorities before the effective date of Decree 118/2018/ND-CP;

(ii) Military and civil medical clinics: only established in border communes, border districts, island communes, island districts, communes, and districts in extremely difficult socio-economic areas;

(iii) Military and civilian medical centers: only established in island and border districts;

(iv) Military and civilian medical stations: only established in border communes, island communes, and communes in extremely difficult socio-economic areas where there are no organizational forms specified in (i), (ii), and (iii).
