From July 1, 2021: Copy of the household registration book not required for issuing judicial record card in Vietnam

Decision 1050/QD-BTP dated June 23, 2021 on amending the application composition when carrying out the procedure for granting a judicial record card. In particular, from July 1, 2021, people do not need to bring a copy of the household registration book when going to make a judicial record card in Vietnam.

Specifically, Decision 1050/QD-BTP stipulates the composition of documents when carrying out the procedures for the issuance of judicial record cards, including:

-A declaration requesting the issuance of a criminal record card according to the prescribed form (Form No. 03/2013/TT-LLTP; Form No. 04/2013/TT-LLTP).

Currently, Decision 2244/QD-BTP dated August 24, 2018 requires a copy of the household registration book or temporary residence book or the certificate of permanent or temporary residence of the person issued with a criminal record card.

-A copy of the Vietnamese citizen's identity card or citizen identification card or passport without identifying the place of permanent residence or temporary residence/a copy of the passport of a foreigner who has resided in Vietnam.

In the case of the submission of photocopies, the original must be presented for comparison.

If the original is not available for comparison, a certified copy shall be submitted as prescribed by the law in Vietnam.

For foreigners already residing in Vietnam, passports must be stamped by the immigration control unit of Vietnam.

-The power of attorney in the case of authorizing another person to carry out the procedures for requesting the issuance of a judicial record card No. 1 (in case the authorized person is the father, mother, wife, husband, or child of the authorizing person, it is not necessary to issue a letter of authorization). authorization documents). The power of attorney must be notarized and authenticated according to the provisions of Vietnamese law or the law of the country where the person is a citizen or permanent resident.

In the case of authorization according to the provisions of the law of the country of which such a person is a citizen or permanent resident, the authorization document must be consularly legalized according to the provisions of Vietnamese law and translated into Vietnamese.

Individuals requesting the issuance of Criminal Record Cards No. 2 may not authorize others to carry out the procedures for requesting the issuance of Criminal Record Cards.

In addition, the person requesting the issuance of a judicial record card that is eligible for fee exemption or reduction must present documents to prove it.

Thus, starting from July 1, 2021, people do not need to carry a copy of the household registration book, temporary residence book, or the certificate of permanent or temporary residence when carrying out the procedures for issuance of a judicial record card.

Clause 4, Article 37 of the Law on Residence 2020, point b, Clause 1, Article 45 of the 2009 Law on Criminal Records has been annulled.

"Article 45. Procedures for requesting the issuance of judicial record card No. 1

1. The person requesting the issuance of a judicial record card shall submit a declaration requesting the issuance of a judicial record card together with the following papers:

...b) A copy of the household registration book or certificate of permanent or temporary residence of the person issued with the judicial record card."
