From July 1, 2021: Additional locations for residence inspections in Vietnam

The residence inspection is conducted periodically, irregularly or due to the requirements of crime prevention and control, ensuring security and order in Vietnam according to Article 25 of Circular 55/2021/TT-BCA stipulating instructions on Law on Residence. in which, from July 1, 2021, there will be more residence inspection sites.

From July 1, 2021: Additional subjects and locations for residence inspections in Vietnam (Illustration)

Specifically, in Clause 2 of Article 25 of Circular 55/2021/TT-BCA, stipulating that the entities and locations subject to residence inspection are:

- Citizens, households;

- Dormitories, student housing, worker housing;

- Housing area for employees;

- Houses for rent, houses for loan, or stay-at-home of organizations and individuals;

- Folk religious establishments, religious establishments;

- Social support facilities, healthcare establishments, tourist accommodations and other types of lodgings;

- Tourist accommodation establishments and other establishments with accommodation functions;

- Residence registration agencies at all levels;

- Agencies and organizations related to residence management

Currently, only the subjects of residence inspection are citizens, households, accommodation rental establishments, residence registration and management agencies at all levels; agencies and organizations related to residence management (Clause 2, Article 26 of Circular 35/2014/TT-BCA expires July 1, 2021).

What is the residence inspections?

- Check the implementation and implementation of registration and residence management contents;

- Collect, update, and exploit residence information in the Residency Database (new content compared to Circular 35/2014/TT-BCA);

- Rights and responsibilities of citizens, households, agencies, and organizations;

- Other contents according to the law of residence.

Penalties for not complying with regulations on residence inspection

According to Point c, Clause 1, Article 8 of Decree 167/2013/ND-CP, if they fail to comply with the household registration inspection, temporary residence inspection, and residence inspection, or fail to present the household registration book, temporary residence book, or certificate, Other documents related to residence that are requested by a competent authority will be fined:

-From 100,000 VND to 300,000 VND (for individuals)

-From 200,000 VND to 600,000 VND (for organizations)
