Regarding this issue, LawNet would like to answer as follows:
Officials who propose innovation and creativity, individuals and organizations implementing innovation and creativity proposals, and agencies and heads of agencies that employ officials in the cases specified in Clause 1, Article 5 of Decree 73/2023/ND-CP are encouraged to submit the following forms according to relevant laws:
- Commend and praise in front of the collective agencies and units; be rewarded according to the provisions of law on emulation and commendation for proposals that are assessed as completed;
- Be used as a basis for evaluation before classification, appointment, reappointment, planning, mobilization, and rotation in the direction of prioritizing the arrangement and use of staff with innovative thinking and creative and highly effective ways of working;
- Be assessed as having excellent achievements in public service activities to be considered for civil servant rank promotion; be considered for salary increase 12 months before the deadline according to the provisions of law for innovation and creativity proposals that are assessed as completed;
- Be encouraged in other forms in accordance with the Party's regulations and State laws.
Officials, individuals, and organizations implementing proposals, depending on the specific case, the agency employing the staff will promptly arrange equipment, working facilities, people, and funding to ensure the implementation of the approved proposal.
(Article 10 of Decree 73/2023/ND-CP)
Specifically, Article 11 of Decree 73/2023/ND-CP stipulates measures to protect officials who propose innovation and creativity, including:
- Officials implementing innovation and creativity proposals in the case specified in Point a, Clause 2, Article 5 of Decree 73/2023/ND-CP will not be held accountable according to relevant laws.
- Officials who make innovation and creativity proposals that do not complete or only partially complete the set goals but the agency employing the staff has reviewed and assessed that they have implemented the policy correctly, have pure motives, and are for the common good as prescribed in Point b, Clause 2, Article 5 of Decree 73/2023/ND-CP shall be excluded from liability according to relevant laws.
- Officials implement innovation and creativity proposals that do not complete or only partially complete the set goals and cause damage, but the agency employing the staff has reviewed and assessed that they have implemented the policy correctly, have pure motives, and are for the common good as prescribed in Point b, Clause 2, Article 5 of Decree 73/2023/ND-CP shall be considered for exclusion, exemption, or reduction of liability according to relevant provisions of law.
- The agency and the head of the agency employing the staff who decide to allow the implementation of innovative and creative proposals must promptly review and evaluate implementation results, clearly identify objective and subjective causes, and make an objective and comprehensive assessment for the cases specified in Clauses 1, 2 and 3, Article 11 of Decree 73/2023/ND-CP.
According to Article 14 of Decree 73/2023/ND-CP, responsibilities of officials who propose innovation and creativity and individuals and organizations implementing innovation and creativity proposals are as follows:
- Attend meetings of the leadership team and the Proposal Evaluation Council to present and express opinions.
- Chair or coordinate with individuals and organizations assigned to receive and complete proposals based on the conclusions of the leadership team and the proposal evaluation council.
- Effective and economical use of resources; proactively and coordinate with agencies, organizations, and individuals in organizing the implementation of proposals and overcoming arising consequences (if any).
- Report honestly, fully, and promptly on innovation and creativity proposals, implementation status, advantages, difficulties, and results of proposal implementation; seek guidance from the agency employing the staff when any problems arise during the implementation process.
- Comply with decisions of the employing agency.
