1. Forms of exploitation and use of the national database on handling of administrative violations in Vietnam

The forms of exploitation and use of the National Database on handling of administrative violations according to Clause 1, Article 16 of Decree 20/2016/ND-CP include:

• Connecting via computer network with the National Database on handling of administrative violations;

• Searching information online on the electronic information portal stipulated by the Ministry of Justice of Vietnam;

• Written request.

2. Regulations on connection, data integration, and information access in the National Database on handling of administrative violations in Vietnam

Regulations on connection, data integration, and information access in the National Database on handling of administrative violations according to Article 18 of Decree 20/2016/ND-CP are as follows:

• Principles of connection, data integration, and information access in the National Database on handling of administrative violations:

  • The agency managing the National Database on handling of administrative violations only permits access to the database with specialized databases that have been connected to the National Database on handling of administrative violations to perform assigned functions, tasks, and powers;

  • Other specialized databases that utilize data on administrative violations must ensure the capability of connecting and integrating data with the National Database on handling of administrative violations when being upgraded or newly built;

  • The connection, data integration, and information access in the National Database on handling of administrative violations are carried out according to the technical standards for IT application in state agencies.

• Procedures for connection, data integration, and information access in the National Database on handling of administrative violations:

  • The head of the agency managing the specialized database sends a written request for connection, data integration, and information access in the National Database on handling of administrative violations to the Ministry of Justice of Vietnam. The document specifies the assigned functions, tasks, powers, scope, connection methods, data integration, purpose, and number of information fields that need access;

  • The Minister of Justice decides on the methods of connection, data integration, and the number of information fields shared between the National Database on handling of administrative violations and the specialized database to fit the scope of functions, tasks, and powers of the agency managing the specialized database.

3. Regulations on maintenance, upgrade, and development of the National Database on handling of administrative violations in Vietnam

Regulations on maintenance, upgrade, and development of the National Database on handling of administrative violations according to Article 15 of Decree 20/2016/ND-CP are as follows:

• The Ministry of Justice of Vietnam carries out the maintenance of the National Database on handling of administrative violations as follows:

  • Ensuring the technical infrastructure system and environment for the installation and operation of the National Database on handling of administrative violations;

  • Implementing measures to ensure physical and environmental safety at the electronic data center of the National Database on handling of administrative violations;

  • Taking measures for backup and contingency to ensure the ability to troubleshoot, and recover data in case of disasters or unauthorized alteration, modification, deletion, or destruction;

  • Executing maintenance, repair, and servicing measures to ensure that the National Database on handling of administrative violations operates continuously 24 hours daily.

• The Ministry of Justice of Vietnam periodically reviews and proposes upgrade and development plans for the technical infrastructure and software of the National Database on handling of administrative violations to fit practical requirements.
