1. Principles of military registration in Vietnam

According to Article 11 of the Law on Military Service 2015, the principles of military registration and management of citizen at the age subject to military recruitment are as follows:

- Conformable with the entities, procedures and policies prescribed in the laws.

- Constant, transparent and convenient for citizens.

- The management shall be close to have exact information about quality, quantity and records of citizens subject to military service.

- Any modification in residence of citizens subject to military service shall be registered and managed according to the laws.

2. Entities subject to registration for military service in Vietnam

Pursuant to Article 12 of the Law on Military Service 2015, entities subject to registration for military service include:

- Male citizens turn 17 years old and above

- Female citizens specified in clause 2 Article 7 of the Law on Military Service 2015 turn 18 years old and above.

3. Entities must not register for military service in Vietnam

Pursuant to Article 13 of the Law on Military Service 2015, regulations on entities must not register for military service are as follows:

- Citizens in any of the following cases must not register for military service:

+ Any citizen who is facing criminal prosecution; serving the prison sentence, non-custodial re-education, bearing surveillance or citizen who has carried out the prison sentence but without expunging of criminal record;

+ Any citizen who is bearing education at communes or is being at reform school, compulsory re-education schools, compulsory detoxification centers;

+ Any citizen whose right to serve in People’s armed forces is revoked.

- When the duration of measures specified in clause 1 of this Article expired, the citizen may register for military service.

4. Procedures for first-time military service registration in Vietnam

Specifically, Decision 4089/QD-BQP dated August 29, 2023 stipulates the procedures for first-time military service registration as follows:

* The order of execution:

- Step 1: 10 days before the deadline, up to the date of military service registration, the commune-level Military Command is responsible for sending the Call to register for military service to the citizen. In case: an agency or organization does not have a Military Command, the head or legal representative of the agency or organization is responsible for transferring the Military Service Registration Order to the citizen.

- Step 2: After receiving the Military Service Registration Call from the Commander of the Military Command of the district, town, provincial city and equivalent administrative unit (hereinafter referred to as the Commander of the District Military Command), citizens have the responsibility to go to the military commands of communes, wards, townships, agencies, and organizations (hereinafter collectively referred to as the commune-level military commands) to directly register for military service.

- Step 3: Within 01 working day, the Commune-level Military Command is responsible for comparing the original ID card, Citizen Identification card or birth certificate; instructing citizens to declare their health self-declaration form for military service; registering the necessary information of citizens in the List of male citizens who have reached 17 years of age during the year; registering citizens ready to enlist; and transferring the Military Service Registration Certificate to citizens immediately after registration.

* Form of registration: People carry out the procedures directly to the commune-level Military Command to register for military service.

* Application consists of:

- Self-declaration form for military service;

- Photocopy of one of the following documents: Identity card; Citizen ID card or birth certificate (bring the original for comparison).

In cases where a competent agency or person is assigned responsibility for receiving and handling administrative procedures, providing public services, and exploiting citizen information in the National Population Database
does not require citizens to submit a photocopy of their identity card; Citizen ID card or birth certificate (bring the original for comparison).

* Number of documents: 01 set.

* Processing time: 01 working day.
