Regarding this issue, LawNet would like to answer as follows:
According to Article 4 of the Regulations issued together with Circular 28/2009/TT-BGDDT, in addition to the duties for teachers specified in Article 3 of the Regulations issued together with Circular 28/2009/TT-BGDDT (amended in Circular 15/2017/TT-BGDDT), homeroom teachers also have the following duties:
- Learn and understand the students in the class in all aspects to have measures to organize education close to the target audience to promote the progress of each student and the whole class;
- Coordinate closely with students' families; proactively coordinate with subject teachers, the Ho Chi Minh Communist Youth Union, the Ho Chi Minh Young Pioneers Team, unions, and other social organizations involved in teaching and educating students in their class;
- Comment, evaluate, and grade students at the end of the semester and the end of the school year; recommend rewards and discipline for students; propose a list of students to be promoted to the next grade; list of students who must be re-checked; have additional behavioral training during the summer vacation; stay in class; and complete the recording in the grade book and student report card;
- Participate in guiding collective activities and educational and student training activities organized by the school;
- Report regularly or unexpectedly on the class situation to the Principal.
Working time and annual leave of teachers according to Article 5 of the Regulations issued together with Circular 28/2009/TT-BGDDT (amended in Circular 15/2017/TT-BGDDT) are as follows:
- The working time of primary school teachers during the school year is 42 weeks, of which:
+ 35 weeks for teaching and educational activities according to regulations on school year planning.
+ 05 weeks for studying and improving qualifications.
+ 01 week for preparing for the new school year.
+ 01 week for summarizing the school year.
- The working time of middle school and high school teachers during the school year is 42 weeks, of which:
+ 37 weeks for teaching and educational activities according to regulations on school year planning.
+ 03 weeks for studying and improving qualifications.
+ 01 week for preparing for the new school year.
+ 01 week for summarizing the school year.
- The working time of a university preparatory school teacher is 42 weeks, of which:
+ 28 weeks for teaching and educational activities according to regulations on school year planning;
+ 12 weeks for studying, improving qualifications, developing documents, scientific research, and a number of other activities according to the school year plan;
+ 01 week for preparing for the new school year;
+ 01 week for summarizing the school year.
- Teachers' annual leave includes: summer vacation, lunar new year vacation, semester vacation, and other holidays, specifically as follows:
+ Teachers' annual summer vacation period is 02 months (including annual leave according to the provisions of the Labor Code), with full salary and allowances (if any).
+ Lunar New Year holiday and semester break according to regulations of the Minister of Education and Training;
+ Other days off according to the provisions of the Labor Code.
Based on the school year plan, scale, characteristics, and specific conditions of each school, the Principal arranges annual leave time for teachers in a reasonable manner according to regulations.
