Regarding this issue, LawNet would like to answer as follows:
- Regional State Reserve Department is an organization under the General Department of State Reserves, performing the function of directly managing national reserves and state management of national reserves in the area according to the provisions of law.
- The Regional State Reserve has legal status, its own seal, and is allowed to open an account at the State Treasury according to the provisions of the law.

The duties and powers of the Regional State Reserve are specified in Article 2 of Decision 315/QD-BTC 2020, including:
- Submit to the General Director of the State Reserve to decide:
+ Long-term, 5-year, and annual development planning and plans for national reserves in the area under management;
+ Programs, plans, projects, and schemes to implement assigned tasks;
+ National reserve plan in the area within the scope of management and annual budget estimates of the unit.
- Organize the implementation of planning, plans, programs, projects, schemes, and budget estimates after they are issued or approved.
- Inspect and examine compliance with national reserve laws for agencies and units directly managing national reserve goods, organizations and individuals using national reserve goods in areas of management under their jurisdiction or at the request of the Director General of the General Department of State Reserves; handle according to authority or submit to the Director General of the General Department of State Reserves for handling violations of national reserve laws according to the provisions of law; inspect and examine the implementation of assigned tasks by affiliated units; resolve complaints and denunciations; prevent and combat corruption and negativity; and practice thrift and combat waste according to the provisions of law.
- Carry out the purchase, sale, import, and export of national reserve goods according to the assigned plans or decisions of competent authorities according to the provisions of law; Develop purchasing and selling price plans for national reserve goods according to regulations.
- Implement national reserve goods for relief, rescue, support, international aid, or to meet other unexpected and urgent requirements according to the decision of the competent authority, ensuring timely, adequate quantity, quality, and efficiency.
- Carry out the management and preservation of national reserves; manage the quality of national reserve goods according to national standards and technical regulations; and manage and organize the implementation of economic and technical norms according to the provisions of law.
- Carry out protection, security, fire, explosion, storm, and flood prevention, and ensure the safety of national reserves according to the regulations of the State and the General Department of State Reserves.
- Organize the effective management and use of assigned assets and resources; financial management, prices, fees, accounting, internal inspection, and settlement, according to the provisions of law.
- Carry out investment in the construction, renovation, and repair of reserve warehouse systems and technical facilities according to the provisions of law and management decentralization of the Ministry of Finance and the General Department of State Reserves.
- Deploy and apply scientific and technical advances and technology; Modernize the management and preservation of national reserves according to programs and plans approved by competent authorities; Implement administrative reform in the import, export, purchase, and sale of national reserve goods.
- Implement information technology applications; organize the implementation of statistical work and regular and irregular reporting according to the provisions of the law and the requests of competent authorities.
- Manage organizational structure, payroll, implementing salary regimes and other benefits, emulation and reward policies, discipline, and training for civil servants and employees of the unit according to State regulations, and management decentralization of the Minister of Finance and Director General of the General Department of State Reserves.
- Propagate, disseminate, and educate about national reserve laws; guide organizations and individuals to comply with national reserve laws in the process of receiving, managing, and using national reserve goods according to the decisions of competent authorities. Summarize practice, make recommendations, and participate in the development of legal documents, rules, and regulations on national reserve management.
- Report to the People's Committees of provinces and centrally run cities according to assigned areas and coordinate with relevant local specialized agencies in implementing planning and plans for buying, selling, importing, and exporting national reserve goods.
- The Director of the Regional State Reserve Department is entitled to promulgate regulations and regulations for unit management and issue individual decisions according to his/her authority; to sign documents guiding, explaining, and answering issues related to assigned functions and tasks or documents authorized by the Director General of the General Department of State Reserves according to the provisions of law.
- Contact and coordinate with relevant agencies and units to organize and implement assigned tasks.
- Perform other tasks and powers assigned by the Director General of the General Department of State Reserves and according to the provisions of law.
