1. Position and functions of the Judicial Academy

- Location of the Judicial Academy

The Academy of Justice (hereinafter referred to as the Academy) is a public service organization under the Ministry of Justice, operating under the University Charter.

The Academy has legal status, has its own seal and account according to the provisions of law, is headquartered in Hanoi, and the campus is in Ho Chi Minh City.

- Functions of the Judicial Academy

+ Training in trial skills, prosecution skills, civil judgment enforcement skills, lawyer profession, notary profession, auction profession, and other judicial and judicial support positions under the management authority of the Ministry of Justice for subjects who have bachelor's degrees in law and specialized bachelor's degrees appropriate to the training title (postgraduate training);

+ Training to improve professional qualifications, skills, and legal knowledge
for judicial positions, judicial assistants, civil servants, and public employees under the management authority of the Ministry of Justice and other subjects according to social needs;

+ Scientific research to serve the training and fostering of judicial positions, judicial assistance, and social needs;

+ Legal advice.

2. Duties and powers of the Judicial Academy

The duties and powers of the Judicial Academy are specified in Article 2 of Decision 2229/QD-BTP of 2015, including:

- Develop and submit to the Minister of Justice for approval the Academy's development strategy, long-term, 5 (five) year and annual work plans; participate in building strategies, planning, and development plans of the Justice Sector.

- Preside and participate in the development of schemes and projects, and draft legal documents on training and fostering judicial positions for the Minister of Justice to promulgate or submit to competent authorities for promulgation. ; Participate in developing, appraising, and providing comments on other projects and draft legal documents assigned by the Minister of Justice.

- Develop and submit to the Minister of Justice for approval and organize the implementation of planning, training, and scientific research plans within the scope of assigned functions and tasks; on organizational structure, job positions, recruitment, management, building, and training of the Academy's team of civil servants, public employees, and workers according to the provisions of law and decentralization of the Ministry of Justice.

- Organize training activities, including:

+ Training in trial skills, prosecution skills, civil judgment enforcement skills, lawyer profession, notary profession, auction profession, and other judicial and judicial support positions under the jurisdiction of the Ministry of Justice (civil judgment enforcement examiner, civil judgment enforcement clerk, legal assistant, secured transaction registrar, bailiff, bailiff secretary, civil servants and public employees working on judicial records, arbitrators, financial administrators, and other positions as prescribed by law), general training for appointing judges, prosecutors, and lawyers (when assigned tasks);

+ Fostering and improving professional qualifications and updating new knowledge for judicial positions, judicial assistants, civil servants, and public employees of the Justice Sector;

+ Fostering and updating legal knowledge for organizations and individuals in need.

- Organize and implement training programs and plans, and manage students; Coordinate with agencies and organizations to well implement the goal of comprehensive training for students.

- Organize the compilation, appraisal, and release of textbooks, reference books, Legal Profession Magazine, and documents to serve the teaching, learning, and scientific research of the Academy according to legal regulations.

- Ensuring training quality; organizing self-assessment of training quality according to legal regulations.

- Issuing diplomas and training certificates according to the provisions of the law.

- Organize and carry out scientific research activities; apply and develop scientific research results to improve the quality of training; foster and serve the activities of the Justice sector.

- Cooperate and associate with domestic and foreign organizations and individuals in training, fostering, legal consulting, and scientific research activities according to the provisions of the law and the decentralization of the Ministry of Justice, in accordance with the functions and tasks of the Academy.

- Build and develop information systems, documents, libraries, and equipment to meet the requirements of improving the quality of training and fostering scientific research.

- Organize legal consulting activities, provide legal aid, and disseminate legal education according to the provisions of the law and in accordance with the functions and tasks of the Academy.

- Implement the Academy's financial and accounting regime according to the provisions of the law and decentralize the Ministry of Justice.

- Manage and use the land, facilities, assets, and equipment of the Academy according to the provisions of law.

- Mobilize, manage, and use financial resources to carry out assigned tasks according to the provisions of the law and the decentralization of the Ministry of Justice.

- Organize and implement emulation and reward work according to the provisions of the law and the decentralization of the Ministry of Justice.

- Resolve the complaint report; implement anti-corruption and negative actions; practice thrift and combat waste in the Academy's operations; carry out inspection and examination according to the provisions of law.

- Implement statistics, information, and periodic or extraordinary reports on fields and tasks within the scope of the Academy's functions according to regulations.

- Organize and implement grassroots democracy regulations; build a cultural lifestyle and pedagogical environment in the Academy.

- Perform other tasks assigned by the Minister of Justice.
