1. Does losing a Party member card result in being expelled from the Party in Vietnam?

In Article 29 of Regulation 69-QD/TW of 2022, there are regulations on violations of regulations on organization and personnel work as follows:

- Party members who violate one of the following cases, causing less serious consequences, will be disciplined in the form of reprimand:

+ Intervene and influence competent organizations and individuals for oneself or others to be elected, appointed, planned, appointed, reappointed, rotated, transferred, dismissed, resigned, nominated, enrolled, conferred, promoted, or recognized title, rank, recognition of title qualifications, rank promotion exam, salary increase, going abroad, implementing staff regimes and policies contrary to regulations.

+ Direct or request the appointment of people who do not meet the prescribed qualifications and standards.

+ Improper implementation of principles, processes, and procedures for staff work; Failure to comply with regulations on staff work; falsifying or arbitrarily correcting documents and records of party members, officials, civil servants, public employees, and workers; Comments and assessments of officials are unfounded, dishonest, and not objective.

+ Failure to comply with decisions on appointment, transfer, rotation, work assignment, leave, sending to study, or transfer to party activities according to regulations.

+ Carry out appraisal, consultation, recommendation, and decision on reception, recruitment for promotion exams, grades, schooling, planning, appointment, reappointment, rotation, introduction for election, candidacy, commendation, conferment, rank promotion, recognition of titles and qualifications for parents (yours, your spouse's), your wife (husband), biological children, adopted children, and siblings (yours, your spouse's) who do not meet the qualifications standards, conditions.

+ Directing or assessing, advising, proposing, and implementing recruitment, reception, work arrangements, appointments, conferments, promotion, recognition of titles, ranks, and recognition of title standards; rotation, transfer, promotion, reward, and discipline that do not comply with principles, procedures, and regulations; Planning, training, and sending people to work abroad are not qualified.

+ Losing the party member card without a legitimate reason; commenting, requesting admission, and recognizing official party members who do not meet the standards, conditions, processes, and procedures;

+ Improperly implementing regulations on party members' transfer to party activities or submitting documents to transfer party activities in contravention of regulations; Failure to write notice of party members' transfer of party activities; Confirming Party age for Party members does not comply with regulations.

+ Reporting, documenting, providing a brief resume, and personal and family history that is incomplete and dishonest. Declaring a party membership profile that does not match one's political characteristics and family relationships.

- In case of being disciplined as mentioned above and repeating the violation, or if the first violation causes serious consequences or violates one of the following cases, discipline will be in the form of a warning or dismissal (if there is a position):

+ Due to personal motives, transfer, dismissal, release from position, dismissal, discipline, and settlement of regimes and policies towards cadres, party members, civil servants, public employees, and workers not in accordance with regulations.

+ Direct or receive, recruit, arrange, and arrange personnel who are not allowed by law to work at their agency, unit, or organization.

+ Taking advantage of regulations on rotation and periodic change of working positions to repress cadres, party members, civil servants, public employees, and workers.

+ Covering officials, party members, civil servants, public employees, and workers who are being examined, inspected, investigated, and considered for discipline.

+ Irresponsible or because of personal motives, direct or carry out appraisals, proposals, and decisions on recruitment, planning, appointment, rotation, election introduction, candidacy, conferment, and rank promotion; recognition of titles; recognition of title standards; rewards that do not meet standards and conditions; or decisions to unfairly discipline cadres, party members, civil servants, public employees, and workers.

+ Committing dishonest acts in order to be promoted, raise salary, considered for recognition of title standards, rewarded, recognized with titles, or enjoy regimes and policies contrary to regulations.

+ Advise competent authorities to make decisions or give opinions on organizational and staff work that do not comply with principles, processes, procedures, and authority, confirming, corroborating, commenting, evaluating untruthfully or falsifying personnel records, election results, taking recommendation votes, confidence votes, admission, and entrance exams.

+ Taking advantage of the position and authority of the head to make decisions that do not comply with principles, regulations, and authority regarding organizational and staff work.

+ Not being honest, not being exemplary, knowing that they do not meet the standards and conditions, but still finding ways to be accepted, recruited, planned, rotated, appointed, introduced for election, nominated, promoted, recognition of titles, ranks, recognition of title standards, rewards, benefits, and policies contrary to regulations.

+ Lack of responsibility or personal motive to misplace or lose records of cadres, party members, documents, and records of party organizations under management responsibility; providing cadre records and party membership records to irresponsible people.

+ Taking advantage of mass media and social networks to spread untrue, distorted, and inciting news, causing internal disunity and negatively affecting human resources work.

- In case of violating the above regulations, causing very serious consequences, or violating one of the following, discipline will be in the form of expulsion:

+ Brokering, accepting bribes in receiving, recruiting, appointing, re-appointing, assigning work, salary increases, rank promotions, rewards, discipline,
Consider recognizing qualifications for titles and conferring titles on cadres, party members, civil servants, public employees, and workers.

+ Committing acts of manipulating age, seniority, title, discipline, qualifications, work position, rotation, etc. to take advantage of oneself or others.

+ Taking advantage of positions, powers, and working positions to create conditions, influence, and intervene illegally in the reception, recruitment, planning, mobilization, rotation, appointment, and placement of staff.

+ Forging or falsifying records and documents to study, receive, or be recruited into agencies or organizations.

+ Using party member cards, industry cards, and civil servant cards to mortgage, borrow money, and own assets.

Thus, in case a Party member loses his or her Party member card without a legitimate reason, he or she will be disciplined and reprimanded. In case a Party member loses his or her Party member card for the second time without a legitimate reason or commits the first violation but causes very serious consequences, he or she will be disciplined and expelled from the Party.

2. What are the procedures for re-issuing a lost party member card in Vietnam?

At point c, detail 2.2, subsection 2, Section II, Instruction 12-HD/BTCTW 2022 has regulations on the process of card making, card distribution, and party member card management as follows:

- Based on the reasons for lost or damaged cards in the party member's review, review and collect 2 portrait photos (size 2 x 3 cm) to send along with the list of requests to the grassroots Party Committee;

The grassroots Party Committee reviews and sends the list (according to Forms 2-TĐV and 3-TĐV) to the competent party committee;

Organizing Committee of Party Committee has the authority to compile a list (according to Forms 2A-TĐV and 3A-TĐV) and report to the Party Committee's Standing committee for consideration and a decision to re-issue lost party member cards or replace damaged party member cards (according to form 4-TĐV).

- After the decision of the Party Committee, the Party Committee's organizing committee completes the list of reissued lost party member cards and replaces damaged party member cards in the Party membership database management software.

If there is no network connection to the provincial server, export the data to a file and send it to the provincial Party Committee or equivalent;

Submit photos of party members to the provincial Party Committee's organizing committee and equivalent; The Provincial Party Committee's organizing committee and equivalent use Party membership database management software to approve and print party member cards, paste photos, emboss stamps, and deliver cards to district party committees, and the equivalent complete cards and deliver them to party cells to give cards to party members.

Thus, the procedure for re-issuing a lost Party member card is as follows:

Step 1: The Party cell considers the reason for losing the Party member card and submits an application including 2 portrait photos (size 2 x 3 cm) and a list of suggestions for the grassroots Party Committee.

Step 2: The organizing committee of the Party Committee has the authority to gather and compile a list to report to the Standing Committee of the Party Committee for consideration and a decision to re-issue lost Party member cards.

Step 3: The Party Committee's organizing committee completes the list of reissued lost Party member cards into the Party membership database management software.

Step 4: The Provincial Party Committee's Organizing Committee and equivalent use the Party Member Database Management software to approve and print Party member cards, paste photos, emboss stamps, and deliver cards to the district party committee and equivalent.

Step 5: The district party committee and equivalent complete the card and hand it over to the cell to give the card to Party members.
