Content of Job position project in public service units in Vietnam

Pursuant to Clause 2, Article 7 of Decree 106/2020/ND-CP, the content of the Job Position Project in public service units includes:

- The necessity and legal basis of developing a job placement project;

- Statistics and grouping of jobs according to functions, tasks, nature, and level of complexity;

- Identify job positions, including: Job position description, competency framework, and professional title of each job position;

- Summary of job positions and structure of public employees according to professional titles of public service units;

- Recommendations and suggestions (if any).

Time limit for appraisal of job position projects in public service units in Vietnam

Pursuant to Clause 3, Article 7 of Decree 106/2020/ND-CP, within 40 days (for documents requesting initial appraisal and approval) and 25 days (for documents requesting adjustments) from the date of receipt of complete documents, agencies and organizations assigned the responsibility to appraise the job position proposal specified in Clause 3, Article 6 of Decree 106/2020/ND-CP must complete the appraisal to submit to competent authorities for consideration and a decision to approve the employment positions and structure of public employees according to the professional titles of public service units under their management.

In case the competent authority decides not to agree, notify the public service unit in writing and clearly state the reason.

Procedure for approving job positions in public service units in Vietnam

- Public service units cover their own recurrent and investment expenditures

Pursuant to Clause 1, Article 4 of Decree 106/2020/ND-CP, the public service unit develops a job position project, organizes an appraisal, and submits it to the head of the public service unit for submission to the Management Council for approval; The head of the public service unit decides to approve the job positions and employee structure according to the unit's professional title after being approved by the Management Council.

- Public service units cover their own regular expenses

Pursuant to Clause 1, Article 4 of Decree 106/2020/ND-CP and guiding documents of competent authorities on employment positions and structure of public employees by professional title by industry and field, the public service unit develops a job position project, organizes an appraisal, and submits it to the head of the public service unit to decide whether to approve job positions and structure of public employees according to the professional title of the unit. If a public service unit has a Management Council, the head of the unit must submit it to the Management Council for approval before deciding whether to approve job positions and employee structure by professional title.

- Public service units cover part of their regular expenses and public service units have their regular expenses covered by the state budget.

+ Pursuant to Clause 1, Article 4 of Decree 106/2020/ND-CP and guiding documents of competent authorities on job positions and structure of public employees by professional title by industry and field, the public service unit shall develop a job position project and report it to the direct superior agency to report to the agency or organization as prescribed in Point b of this Clause for appraisal.

+ Agencies and organizations assigned the task of organizing personnel of ministries, ministerial-level agencies, and agencies under the Government, organizations established by the Government or the Prime Minister that are not public service units, Hanoi National University, Ho Chi Minh City National University, People's Committees of provinces and centrally run cities (hereinafter collectively referred to as ministries, branches, and localities)or the agency or organization assigned the task of organizing and staffing the agency or organization that is decentralized and authorized to manage and use the job position according to regulations, receive dossiers, organize appraisals of job position projects of public service units, and submit them to competent authorities for approval.

+ Ministers, Heads of ministerial-level agencies, Heads of Government agencies, heads of organizations established by the Government or Prime Minister that are not public service units, Director of Hanoi National University, Director of Ho Chi Minh City National University, People's Committees of provinces and centrally run cities (hereinafter collectively referred to as Provincial People's Committees)
or an agency or organization that is decentralized or authorized to manage and use job positions according to regulations approving job positions and employee structure according to professional titles of public service units within the scope of management.

- The school council of a public university issues a list of job positions for the unit according to the provisions of the Law on Higher Education and Decree 106/2020/ND-CP.
