Regarding this issue, LawNet would like to answer as follows:
According to Article 5 of Circular 60/2021/TT-BCA, after receiving a request for the issuance, renewal, or reissuance of a citizen identification card, a citizen information collector shall do the following:
- Searching for citizen information in the National Population Database to compile a dossier for the issuance, renewal, and reissue of Citizen Identity Cards.
+ In cases where citizen information is already in the National Population Database and there is no change or adjustment, use the citizen's information in the National Population Database to compile a dossier for the issuance, renewal, or reissue of Citizen Identity Cards.
+ In case citizen information is already in the National Population Database but there is a change or adjustment then request citizens to present legal papers proving the changed content in order to update and supplement information in the application for issuance, renewal, and reissue of Citizen Identity Cards.
+ In case citizen information is not available in the National Population Database then request citizens to present one of the legal papers proving the content of personal information in order to update information in the application for issuance, renewal, and reissue of Citizen Identity Cards.
- Select the type of issue of the citizen ID (issue, renew, re-issue) and proceed to describe the identity of the citizen.
- Collect fingerprints of citizens according to the following steps:
+ Acquiring flat fingerprints of 4 fingers of the right hand (index finger, middle finger, ring finger, little finger);
+ Acquiring flat fingerprints of 4 fingers of the left hand (index finger, middle finger, ring finger, little finger);
+ Receiving flat fingerprints of 2 pinched thumbs;
+ Receiving 10 finger rolling fingerprints in order: Right thumb, right index finger, right middle finger, right ring finger, right little finger, left thumb, left index finger, left middle finger, left ring finger, left little finger.
In case 10 fingerprints from the citizen cannot be collected, describe and enter information about the status of the fingerprint not being collected.
- Take portraits of citizens:
Portrait photos of citizens when carrying out procedures for issuance, renewal, and reissue of Citizen Identity Cards is a color photos with a white background, taken from the front, with a bare head, a clear face, clear ears, and no glasses; formal attire; and polite manners.
In the case of citizens following a religion or ethnicity, they may wear that religious vestment or national costume. If they have a headscarf, they may keep it, but their faces and ears must be clearly visible.
- Print the receipt of citizen identification information for citizens to check, sign, and write their full name; Citizens' information-receiving officers shall check, sign, and clearly write their names.
- Print the form for population information collection (if any), the form to update and correct population information (if any) for citizens to check, sign, and write their full name.
- Collect fees as prescribed.
- Revoke the old identity card or citizen identity card in case the citizen carries out the procedures to change from the people's identity card to the citizen's identity card or to change the citizen identity card.
- Issue an appointment letter to return the results of issuance, renewal, and reissue of Citizen Identity Cards to citizens.
- Right within the working day, the citizen receiving information is responsible for handing over the application for issuance, renewal, and re-issuance of the citizen identification card to the file classification department; transferring the form of population information collection (if any), the form of update and correction of population information (if any), to the police of communes, wards, and townships;
Or Police of districts, urban districts, towns, provincial cities, or centrally run cities where there is no commune-level administrative unit (hereinafter abbreviated as Commune-level Police) where the citizen is registered for permanent residence.
Commune-level police offices must carry out verification checks, approve, and update citizen information into the national population database within one working day of receiving the form for collecting population information and updating and correcting residential information.
To receive requests for issuance, renewal, and reissue of Citizen Identity Cards in Vietnam according to Article 4 of Circular 60/2021/TT-BCA as follows:
- Citizens come to the place to carry out procedures for the issuance of citizen's identity cards or through the National Public Service Portal, the Public Service Portal of the Ministry of Public Security to register the time and place to carry out the procedures for applying for, changing, or re-granting a citizen identification card.
- In case a citizen fully meets the conditions for issuance, renewal, and reissue of Citizen Identity Cards, the officer shall receive the request for issuance, renewal, and reissue of Citizen Identity Cards and comply with the provisions of section 2.
- In case the citizen does not satisfy the conditions for issuance, renewal, and reissue of Citizen Identity Cards, the implementing officer shall refuse to accept the request for issuance, renewal, and reissue of Citizen Identity Cards and clearly state the reasons therefor.
- In case of detecting illegal acts, they shall be handled according to regulations.
