Regarding this issue, LawNet would like to answer as follows:

1. Criteria for recognition of spam messages, spam calls, and spam emails in Vietnam

According to Article 4 of Circular 22/2021/TT-BTTTT, criteria for recognition of spam messages, spam calls, and spam emails in Vietnam include:

- A message is identified as a spam message according to the following criteria:

+ The frequency of message sending is the number of messages sent from the message sending source in a period;

+ Pattern: the sending source is mainly used for sending messages and the percentage of making or receiving calls is low; the ratio of sending messages to unrelated subscribers is the ratio of sending messages to unrelated subscribers (that have never been texted before) to total messages;

+ Samples of spam messages are common character patterns for recognition of spam messages including samples of spam messages collected and shared by telecommunications enterprises.

- A call is identified as a spam call according to the following criteria:

+ The frequency of call making is the number of calls made from the call making source in a period;

+ Pattern: the sending source is mainly used for making calls and not receiving or sending messages; the ratio of calls with short contact time is the ratio of calls with short duration (from connection to call termination) to total calls;

The ratio of calls with short intervals between short calls (the time between two consecutive calls) is the ratio of calls with short intervals to total calls; the ratio of calls to unrelated subscribers is the ratio of calls to unrelated phone numbers (that have never been called before) to total calls.

- An email is identified as a spam email according to the following criteria:

+ The frequency of email sending is the number of emails sent from the email sending source in a period;

+ Pattern:

++ The sending source is mainly used for sending emails and not receiving or exchanging information;

++ The ratio of sending emails to unrelated email addresses is the ratio of sending emails to unrelated email addresses (have never exchanged emails before) to total emails.

+ The technology that is used for sending or receiving emails.

2. Instruction on how to report and provide evidence to the receiving system of reports on spam messages, spam emails, and spam calls for users in Vietnam

Pursuant to Article 5 of Circular 22/2021/TT-BTTTT, instruction on how to report and provide evidence to the receiving system of reports on spam messages, spam emails, and spam calls for users is as follows:

- Instruction on how to report and provide evidence of spam messages for users:

+ Send reports via messages to 5656: users compose a reporting message using the syntax: S [Sending source] [Spam content] or S (Sending source) (Spam content) and send it to 5656;

+ Submit reports according to instructions given on thongbaorac.ais.gov.vn or via the switchboard or the application.

- Instruction on how to report and provide evidence of spam calls for users:

+ Send reports via messages to 5656: users compose a reporting message using the syntax: V [Calling source] [Spam content] or V (Calling source) (Spam content) and send it to 5656;

+ Submit reports according to instructions given on thongbaorac.ais.gov.vn or via the switchboard or the application.

- Instruction on how to report and provide evidence of spam emails for users:

+ Submit reports by forwarding spam emails to chongthurac@vncert.vn;  

+ Submit reports according to instructions given on thongbaorac.ais.gov.vn or via the switchboard or the application.
