Regarding this issue, LawNet would like to answer as follows:
According to Clause 1, Article 5 of Circular 02/2023/TT-BCA, the subjects of training in fire safety in the People's Police include:
- Heads and Deputy Heads of Police Departments of Fire Safety and Rescue of the Police Departments of the Provinces and centrally-run cities (hereinafter abbreviated as the Provincial-level Police).
- Chiefs of Public Security and Deputy Heads of Public Security of districts, towns and provincial cities (hereinafter referred to as district-level Police for short) are in charge of fire safety and rescue,
- Team captains and deputy captains of professional teams assigned to perform fire fighting and rescue and rescue tasks under the Fire safety Police Department; Team leaders, deputy captains of police teams for fire safety and rescue and rescue of district-level police offices.
- Officers in charge of training in fire safety and rescue operations.
- Officers and soldiers of fire safety and rescue.
Specifically, in Clause 2, Article 11 of Circular 02/2023/TT-BCA, the evaluation of the results of fire safety training in the People's Police is based on the following criteria:
(i) If the individual specified in Section 1 meets the requirements, he or she must: fully participate in the training contents; the training time must be 80% or more; participate in the test and achieve results of 50% of the total score or more.
(ii) The unit that meets the requirements for the Police Department for Fire Safety and Rescue and the District Police must have at least 90% of the trained officers and soldiers participating in the training content, training time according to regulations, and 80% of officers and soldiers tested to meet the requirements or more.
(iii) An unsatisfactory unit or individual is a case that has not met the criteria specified in (i), (ii).
(iv) Individuals with unsatisfactory test results must re-examine the unsatisfactory content.
The contents of the inspection and evaluation of fire safety training results by the People's Police include:
- Check and evaluate the results according to the issued training program.
- Check the training plans, programs, lesson plans, books to monitor the training, conditions to ensure the training; test plans, inspection records, evaluation of training results, and training reports.
- Check and evaluate the training results according to the report of the training unit.
(Clause 1, Article 11 of Circular 02/2023/TT-BCA)
According to Clause 1, Article 12 of Circular 02/2023/TT-BCA, the competence to evaluate the results of fire safety training in the People's Police is regulated as follows:
- The Director of the Police Department of Fire Safety and Rescue shall establish a council to examine and evaluate the results of advanced training and to examine and evaluate the results of periodic and regular training of the Provincial Police (hereinafter referred to as the Council for Examination and Evaluation of Training Results).
The members of the council to examine and evaluate the training results include: leaders of the Fire Prevention and Fighting Police Department; representatives and leaders of relevant functional units under the Fire Prevention and Fighting Police Department and the Fire and Rescue Police Department, as determined by the Director of the Fire Prevention and Fighting Police Department.
- The director of the provincial-level Police Department shall establish a council to examine and evaluate the results of periodic training and to check and evaluate the results of regular training for the units under his/her management.
The composition of the council to examine and honor the training results includes: leaders of the Provincial Police; leaders of relevant functional units of the provincial-level Public Security Department; and the Director of the provincial-level Public Security.
