Criteria for consideration and recognition of consultants in the field of urban development in Vietnam (Internet image)

The Ministry of Construction of Vietnam issued Decision 439/QD-BXDdated April 28, 2023, which stipulates a set of criteria for recognizing organizations and individuals in the network of consultants to support construction enterprises (the set of criteria). 

1. Criteria for consideration and recognition of consultants in the field of urban development in Vietnam

According to Clause 6, Article 2 of the Criteria issued together with Decision 439/QD-BXD dated April 28, 2023, the criteria for consideration and recognition of consultants in the field of urban development are specified as follows:

(1) For individual consultants:

Individual requirements must meet the following criteria:

- Having full civil act capacity as prescribed by law; having residency papers or work permits in Vietnam for foreigners and overseas Vietnamese.

- Having a professional qualification from a university or higher relevant to the field of consultancy and having at least 05 years' experience in the field of urban development to meet the needs of small and medium-sized enterprises

(2) For consulting organizations:

The organization must meet the following criteria:

- There must be an enterprise in accordance with the law on enterprises or an organization operating in the field of urban development or consulting activities established in accordance with the law.

- There are at least 02 consultants who meet the criteria specified in (1) suitable for the consulting field and meet the needs of small and medium-sized enterprises.

2. Criteria for consideration and recognition of consultants in the field of technical infrastructure in Vietnam

Criteria for the recognition of consultants in the field of technical infrastructure are specified as follows:

(i) For individual consultants:

Individual requirements must meet the following criteria:

- Having full civil act capacity as prescribed by law; having residency papers or work permits in Vietnam for foreigners and overseas Vietnamese.

- Having a professional qualification from a university or higher relevant to the field of consultancy and having at least 05 years of experience in the field of technical infrastructure to meet the needs of small and medium-sized enterprises

(ii) For consulting organizations:

The organization must meet the following criteria:

- There must be an enterprise established in accordance with the law on enterprises or an organization operating in the field of technical infrastructure or consulting activities established in accordance with the law.

- There are at least 02 consultants who meet the criteria specified in (i) suitable for the consulting field and meet the needs of small and medium-sized enterprises.

3. Consulting sector in construction industry in Vietnam

Pursuant to Article 1 of the Criteria issued together with Decision 439/QD-BXD dated April 28, 2023, consulting activities to support small and medium-sized enterprises in the construction industry are carried out in the following fields:

- Construction activities;

- Housing;

- Real estate business;

- Urban development;

- Construction planning, urban planning;

- Architecture;

- Construction materials;

- Technical infrastructure.
