Regarding this issue, LawNet would like to answer as follows:

1. Criteria for awarding the title of Cultural Family as of January 30, 2024 in Vietnam

Criteria for awarding the title of Cultural Family as of January 30, 2024 include:

(1) Be exemplary in complying with the Party's guidelines, policies, and laws of the State

- Family members comply well with the Party's policies and the provisions of the law.

- Implement a civilized lifestyle at weddings, funerals, and festivals according to regulations.

- Ensure implementation of security and order, fire prevention, and fighting.

- Ensuring regulations on noise levels do not affect the community according to environmental laws.

(2) Actively participate in movements to emulate labor, production, study, and protect local security, order, and social safety

- Participate in activities to protect historical - cultural relics, scenic spots, natural landscapes, and the local environment.

- Participate in charity and humanitarian movements; show gratitude; encourage learning; encourage talent; and build a learning family.

- Participate in community activities at your place of residence.

- Actively participate in economic, cultural, and social development movements organized by the locality.

- People of working age who are able to work actively and have a legitimate income.

- Children of school age can go to school.

(3) Families are prosperous, progressive, happy, and civilized; they regularly stick together, unite, support, and help in the community

- Implement well the set of behavioral criteria in the family.

- Implement well-defined population, marriage, and family policies.

- Implement well the goals of gender equality and preventing and combating domestic violence/gender-based violence.

- Households have hygienic toilets, bathrooms, water storage facilities/similar types.

- Support and help people in the community in times of difficulty and distress.

2. In case of not considering awarding the title of Cultural Family

A family member who violates one of the following cases will not be considered for the title of Cultural Family:

- Be prosecuted for criminal liability;

- Failure to complete military service and tax payment obligations;

- Penalized for administrative violations regarding: acts of child marriage, organization of child marriage; violating regulations on marriage, divorce, and violating the monogamous marriage regime;

- Administrative sanctions for: violation of public order regulations; illegal gambling; prevention of social evils; fire prevention and fighting; rescue; and domestic violence prevention and control.

3. Application for consideration of awarding the title of Cultural Family in Vietnam

Dossier to request consideration for awarding Cultural Family titles includes:

- Written request for consideration of awarding the title "Cultural Family" (Form No. 01);

- Summary table of list of households meeting standards and results of public opinion collection (Form No. 02);

- Minutes of meeting to review the title "Cultural Family" (Form No. 03).

4. Procedure for awarding the title of Cultural Family in Vietnam

The order and procedures for considering and awarding the title of Cultural Family are specified in Clause 1, Article 8 of Decree 86/2023/ND-CP as follows:

- Village heads and residential group leaders organize implementation in the following order:

Chair and coordinate with the Head of the Front Working Committee and mass organizations at the same level to organize meetings and evaluate the level of meeting standards of each household within the scope of management.

Compile a list of eligible households to request donation consideration and publicly announce it on a public bulletin board or other forms (if any) to get people's opinions within 10 days.

After the deadline for collecting opinions, prepare documents as prescribed in Clause 1, Article 7 of Decree 86/2023/ND-CP and submit them to the Chairman of the Commune People's Committee for decision.

- Within 10 days from the date of receiving complete documents according to regulations, the Chairman of the Commune People's Committee decides to award the title "Cultural Family" (Form No. 10 of Appendix IV attached to Decree 86/2023/ND-CP).
