Regarding this issue, LawNet would like to answer as follows:

On November 28, 2023, the Minister of Construction issued Decision 1191/QD-BXD regulating testing costs for granting construction practice certificates in Vietnam.

- This regulation applies to agencies/organizations competent to issue practice certificates according to regulations and public service units under state agencies competent to issue practice certificates; Individuals participate in the examination to issue a practicing certificate.

- Regulations on testing costs for granting construction practice certificates (hereinafter referred to as testing costs) in this document are the basis for competent agencies/organizations and individuals participating in the examination to collect, pay, manage and use examination costs.

- Do not use state budget to organize examinations to issue practicing certificates.

1. Costs for testing to issue construction practice certificates in Vietnam

- Testing costs are a set amount of money that individuals must pay when participating in testing to serve the issuance of construction practice certificates, to offset the costs of organizing the testing.

- Individuals participating in the test must pay the test fee once before participating in the test. Testing costs are not refundable in any case.

- Testing costs are collected and used to pay for testing activities of competent agencies/organizations, including:

+ Travel, accommodation, and room expenses for individuals participating in the examination;

+ The cost of organizing the exam includes: the cost of renting the hall, computer room, mid-hour refreshments and other costs directly related to the organization of the exam;

+ Stationery, photocopying, and printing costs for testing;

+ Management and operating costs of the software system;

+ Costs for developing, updating, and supplementing multiple-choice question sets to serve the practice certificate exam.

2. Fees for testing and granting construction practice certificates in Vietnam

- The testing fee is calculated based on the individual's test and is determined as follows: 350,000 VND/test.

- In addition to the testing costs mentioned above, professional social organizations that are recognized as eligible to issue practice certificates themselves develop their own fee rates to serve the assessment of applications for practice certificates of individuals participating in the examination but not exceeding the fee for issuance of construction practice certificates according to regulations of the Ministry of Finance and publicly list them according to regulations.

3. Management and use of testing costs to issue construction practice certificates

- The agency/organization that organizes the testing is responsible for developing and promulgating regulations on revenue and expenditure to manage and use testing costs economically, ensuring the effectiveness of testing activities, in accordance with the provisions of law.

- After each test (no more than 10 days from the date of the test),
The agency/organization collecting testing costs is responsible for transferring the costs of managing and operating the software system and the costs of building, updating, supplementing a set of multiple-choice questions to serve the practice certificate exam at the Department of Construction Management - Ministry of Construction to pay for the unit to manage and operate the software and serve the work of building, updating, and supplementing multiple-choice question sets, specifically as follows:

+ The cost of managing and operating the software system is 60,000 VND/test;

+ The cost of developing, updating, and supplementing the set of multiple-choice questions for the practice certificate exam is 35,000 VND/test.

- The agency/organization collecting and using testing costs shall declare and settle testing costs according to the provisions of law.

Decision 1191/QD-BXD takes effect on November 28, 2023.
