Regarding this issue, LawNet would like to answer as follows:

1. Contents of the prevention of the harmful effects of tobacco in the education sector in Vietnam

According to Article 5 of Decision 3323/QD-BGDDT in 2010, the contents of education and propaganda on the prevention of tobacco harm are as follows:

- Policies and laws on prevention and control of tobacco harms; responsibilities of learners, teachers, officials, and employees of the education sector in implementing regulations on prevention and control of tobacco harms.

- Basic knowledge about the harmful effects of tobacco on health, the economy, and the environment.

- The benefits of smoking cessation and a tobacco-free environment.

- Propaganda to learners, teachers, officials, and employees in the education sector about the harmful effects of tobacco on health, the economy, and the environment.

2. Measures of information, education, and propaganda on the prevention of the harmful effects of tobacco in the education sector in Vietnam

Measures to inform, educate, and propagate on the prevention of tobacco harms specified in Article 6 of Decision 3323/QD-BGDDT in 2010 specifically include:

- Integrating the content of tobacco harm prevention and control into relevant subjects and educational activities outside of class time.

- Organizing contests on learning, painting, rallies, and performing arts for the prevention and control of the harmful effects of tobacco.

- Organizing National No Tobacco Week and World No Tobacco Day on May 31

- Organizing education and propaganda through the activities of Trade unions, the Ho Chi Minh Communist Youth Union, the Vietnam Student Association, the Vietnam Youth Union, and the Ho Chi Minh Young Pioneers Team.

- Working closely with families, local organizations, and mass organizations to propagate and mobilize exemplary parents and relatives not to smoke.

- Coordinating the content of tobacco harm prevention and control with the activities of emulation movements in the education sector and the locality.

3. Activities to prevent the harmful effects of tobacco in the education sector in Vietnam

Article 7 of Decision 3323/QD-BGDDT in 2010 stipulates that activities to prevent the harmful effects of tobacco are implemented as follows:

- Developing rules and regulations for schools and educational management agencies on banning smoking in educational institutions and educational management agencies.

- Hanging the sign or symbol "No smoking" in the corridors, classrooms, meeting rooms, and working rooms at schools and educational management agencies.

- Prohibiting advertising, promotion, marketing, production, and sale of tobacco and tobacco products in schools and educational management agencies.

- It is forbidden to receive direct or indirect sponsorship from the units producing and trading in tobacco products in any form.

- Prohibiting learners, teachers, officials, and employees of the education sector from participating in illegal activities of smuggling, transporting, storing, trading, and consuming tobacco.

- Putting the results of tobacco harm prevention and control activities as one of the emulation evaluation criteria for schools and educational management agencies.

4. Responsibilities of units under the Ministry of Education and Training in the prevention of harmful effects of tobacco in Vietnam

- The Department of Student Affairs is the focal point to assist the Minister in directing the implementation of tobacco harm prevention and control, specifically as follows:

+ Developing a plan to prevent and control the harmful effects of tobacco in the whole industry; To assume the prime responsibility for and coordinate with the Departments of Education, in bringing the content of education on prevention and control of tobacco harms into the curricula.

+ Assuming the prime responsibility for, and coordinating with concerned units in, directing, inspecting, and evaluating the implementation of tobacco harm prevention and control in the whole industry;

+ Annually, sending report to the Minister on the implementation of tobacco harm prevention and control in the whole industry.

- Units under the Ministry of Education and Training are responsible for participating in and coordinating the implementation of activities to prevent and control the harmful effects of tobacco.
