Regarding this issue, LawNet would like to answer as follows:

On September 14, 2023, the Ministry of Culture, Sports, and Tourism issued Decision 2686/QD-BVHTTDL Plan to implement Decree 61/2023/ND-CP on building and implementing village regulations and conventions for the residential community.

Contents of implementation of the Decree on Hyangyak and conventions

Specifically, Decision 2686/QD-BVHTTDL has provided the following contents to implement Decree 61/2023/ND-CP on village regulations and conventions of residential communities:

(1) Ministry of Culture, Sports, and Tourism

- Content

+ Develop documents and materials to implement the Decree.

+ Issue documents directing and guiding the review of approved or recognized local conventions before August 16, 2023.

+ Organize a review of legal documents related to local Hyangyak and conventions; propose amendments, supplements, replacements, and annulments to ensure consistency.

+ Guide the recognition of progressive customs and practices; campaign to eliminate or not apply outdated customs and practices in Hyangyak and conventions.

+ Inspect the construction and implementation of local conventions and regulations according to the provisions of the law.

+ Respond to recommendations and reflections on the implementation of laws on building and implementing Hyangyak and conventionss.

+ Inspect, handle violations, and resolve complaints and denunciations in implementing laws on building and implementing Hyangyak and conventionss.

- The host institution:

+ The Legal Department presides over the above contents (except for the work of commendation and inspection, handling of violations, and resolving complaints and denunciations in implementing the law on building and implementing Hyangyak and conventionss).

+ The Ministry Inspectorate presides over inspections, handling violations, and resolving complaints and denunciations in implementing laws on building and implementing Hyangyak and conventionss.

+ The Department of Personnel and Organization presides over the work of rewarding and implementing village regulations and conventions.

- Coordinating unit: Department of Grassroots Culture, Department of Cultural Heritage, Department of Ethnic Culture, and related agencies and units.

- Implementation time: 2023 and following years.

(2) Locally

- Department of Culture, Sports, and Tourism of provinces and centrally run cities chairs and coordinates with relevant agencies to advise and assist the People's Committees of provinces and centrally run cities in directing the implementation of the following tasks:

+ Review legal documents related to Hyangyak and conventions issued by the People's Committee and People's Council and handle them according to the provisions of the law; at the same time, send the results to the Ministry of Culture, Sports, and Tourism (through the Department of Legal Affairs).

+ Review local Hyangyak and conventions that have been approved or recognized in the area before August 16, 2023, and comply with the provisions of Article 24 of Decree 61/2023/ND-CP.

+ Propose the People's Council at the same level to issue documents on funding support for building and implementing Hyangyak and conventions of local communities according to the provisions of Clause 3, Article 22 of Decree 61/2023/ND-CP, and current legal regulations on state budgets and budget decentralization.

- Completion time: in 2023 and following years.

Requirements for the Plan to Implement Decree 61/2023/ND-CP in Vietnam

According to Decree 61/2023/ND-CP on building and implementing Hyangyak and conventions of residential communities, it is necessary to ensure the following requirements:

- Have a focus; the work content must be associated with the responsibilities of each agency and unit; Determine the coordination mechanism between agencies and units under the Ministry and localities in conducting activities to implement the Decree nationwide;

- Ensure regular and effective coordination between agencies and units under the Ministry and localities in implementing the decree; Determine the specific work contents, completion progress, and responsibilities of relevant agencies and organizations in organizing the implementation of the Decree;

- Regularly inspect, urge, and promptly guide difficulties and problems in the process of organizing and implementing Decree 61/2023/ND-CP.
