Regarding this issue, LawNet would like to answer as follows:
According to Section 4 of the Guidelines promulgated together with Decision 309/QD-TANDTC in 2023, the contents of training and retraining for cadres and civil servants in the court ssystem are as follows:
(1) Expenses for training cadres, civil servants, and public employees
- Expenses for training services, costs of conducting research tasks, and other (mandatory) expenses (if any) related to the training course must be paid to training institutions in the country.
- Financial support to buy compulsory learning materials.
- Partial support for meals during the concentrated study period.
- Support for travel expenses from the agency to the study place (one turn and return; public holidays; Tet holidays); Payment of accommodation rental fees for officials, civil servants, and public employees during the days of studying at training facilities (in case the training institution and the training organization confirm that the accommodation cannot be arranged).
- Cadres, civil servants, and public employees who are female and ethnic minorities who are sent to training are entitled to policies and regimes in accordance with the law on gender equality and ethnic affairs.
(2) Spending on organizing training conferences, retraining, and updating professional knowledge and skills using training and retraining resources for cadres, civil servants, and public employees to perform according to the content of expenditure and the level of expenditure specified in Circular 40/2017/TT-BTC
(3) Expenses for organizing training courses for cadres, civil servants, and public employees
- Expenses incurred by the training institution or the agencies and units assigned to open training courses for cadres, civil servants, and public employees and assigned the task of compiling training programs and documents:
+ Expenses for compiling new programs, textbooks, and training materials or expenses for editing, supplementing, and updating training programs, textbooks, and materials: The assigned agency or unit presides over the compilation of programs and documents for fostering professional knowledge and skills from the annual training and fostering funds;
+ Remuneration for lecturers and teaching assistants; food allowance for lecturers and teaching assistants; expenses for transportation, pick-up, and accommodation for lecturers and teaching assistants;
+ Expenses for compulsory learning materials according to the course content for students (excluding reference materials);
+ Expenses for renting halls, classrooms, and learning equipment (if any);
+ Fees for session rental and translation;
+ Spending on exam questions, watching exams, marking exams; results review board; expenses for opening and closing ceremonies;
+ Spending on drinking water and serving the class;
+ Expenses to organize for students to take surveys and practice (if any);
+ Expenses to reward students with excellent grades;
+ Expenses for common medical drugs for students (if students are sick);
+ Payment for printing and issuance of certificates;
+ Other expenses directly serving the classroom (electricity, water, telecommunications, stationery, cleaning, parking, and other direct expenses);
+ Expenses for activities of direct management of training courses for cadres, civil servants, and public employees: Expenses for travel expenses for class managers of training institutions (if any); overtime expenses of class administrators (if any); and other expenses to serve the management and administration of the class (if any).
The training and retraining institutions for cadres, civil servants, and public employees that have been invested in the construction of rest rooms by the budget must be responsible for arranging accommodation for students who are far away for classes assigned by competent authorities and allocated funds for implementation; No additional fees will be charged for student accommodation.
(i) Expenses incurred in the case of training and retraining through the form of online distance
(ii) Expenses for purchasing and renting equipment, software, and information technology applications to directly serve training and fostering through remote online forms (software for organizing online training and retraining; lectures; simulation software; equipment for remote online teaching; transmission costs; and other information technology costs);
(iii) Expenses for digitizing documents and other expenses directly serving training and fostering through remote online form;
- In cases where an agency or unit is assigned funds to train and retrain cadres, civil servants, and public employees but does not have a training and retraining facility, if they are not qualified to organize your own classes, they must send officials, civil servants, and public employees for training and refresher training at other training and refresher establishments. Agencies and units make payments to training and retraining establishments based on the contract signed between the two parties in accordance with the law on bidding, ordering, and assigning tasks to provide public service services using the state budget from regular expenditure sources.
In cases of ineligible conditions or failure to select a service provider, agencies and units decide to directly support officials, civil servants, and public employees sent to study with tuition fees, money to buy textbooks, mandatory learning materials, and other mandatory expenses payable to training and retraining establishments based on notices, invoices, and documents of the training and retraining establishments.
- Expenses to be paid by agencies and units that send officials, civil servants, and public employees for training: Heads of agencies and units send officials, civil servants, and public employees to training using their regular and other funding sources to support officials, civil servants, and public employees with the following contents:
+ Partial support for students' meals during their study period;
+ Support for travel costs from the office to the place of study (one round trip and return; public holidays; Tet holidays);
+ Payment of accommodation rental fees for students during the days of intensive study at training facilities (if any);
+ Support expenses for officials, civil servants, and public employees who are female and ethnic minorities according to the provisions of the law on gender equality and ethnic affairs.
