Contents of annual marine construction maintenance plan in Vietnam

Circular 19/2022/TT-BGTVT stipulates the formulation, approval, and implementation of maintenance plans for marine works managed by the Ministry of Transport of Vietnam as follows:

(1) The Vietnam Maritime Administration is responsible for planning and estimating funding for maintenance of marine works annually and according to the plan period at the request of competent authorities, and submitting them to the Ministry of Transport for approval.

(2) The content of the marine construction maintenance plan includes the following basic information: the name of the project and the work item (work); unit, volume, estimated cost of implementation; execution time; Implementation methods; priority level. Maintenance plan of marine works according to Form No. 1A and Form No. 1B, Appendix I of Circular 19/2022/TT-BGTVT.

(3) The contents of the annual marine maintenance plan include:

- Maintenance of marine works;

- Periodical repair of marine works: dredging and maintaining public navigational channels, water areas, and water zones; repairing dykes and revetment embankments; repairing wharves and ports; other marine works;

- Unscheduled repair of marine works;

- Other tasks, including: setting up and adjusting the process and norms of management, exploitation, and maintenance for the works invested with the state budget and put into operation and use; accreditation; monitoring; safety assessment; elaboration of economic - technical norms; technology application for management and maintenance of marine works.

(4) The order of making and approving the annual maintenance plan for marine works

- Annually, based on the technical status of the works, information on the scale and structure of the works, the history of the maintenance of the works, the actual navigation routes, water areas, information and other data, technical standards, maintenance procedures, and economic and technical norms, the Vietnam Maritime Administration reviews, synthesizes, plans, and estimates the cost of the maintenance needs of marine works for the next year, and submits it to the Ministry of Transport before May 30 every year;

- The Ministry of Transport shall review and approve the work maintenance demand plan for the following year before June 30 every year; to sum up the plans and estimated maintenance costs into the annual state budget revenue and expenditure estimates of the Ministry of Transport;

- On the basis of the Ministry of Finance's Decision on the assignment of state budget revenue and expenditure estimates and funding for marine construction maintenance, the Vietnam Maritime Administration shall organize the review of the list of necessary works and work items and the planning and estimated funding for the maintenance of the marine works and submit them to the Ministry of Transport within 15 days from the date of receipt of the notice of state budget expenditure estimates from the Ministry of Transport;

- The Ministry of Transport shall approve the plan for maintenance of marine structures within 15 days from the date of receipt of the report from the Vietnam Maritime Administration.

(5) Adjusting and supplementing the maintenance plan for marine works

- In the process of making, appraising, and approving the design and cost estimate of the work, the Vietnam Maritime Administration may adjust the dredging standards, volume, and estimated cost of the work but not  by more than 20% of the estimated cost of the work, does not increase the total cost expected in the approved marine maintenance plan, ensures economic - technical efficiency, maximizes the efficiency of the channel, and at the same time reports to the Ministry of Transport for adjustment; synthesizes and submits to the Ministry of Transport for approval the adjustment of the maintenance plan for marine works before November 1 every year;

- The Vietnam Maritime Administration shall report to the Ministry of Transport for consideration and approval of the adjustment and supplementation of the marine construction maintenance plan in the following cases: increase by more than 20% of the estimated cost of the approved work plan; increase the total estimated cost of implementation; execution time; works are not performed; additional works outside the approved marine maintenance maintenance plan.

(6) The annual marine maintenance plan approved by the Ministry of Transport is one of the bases for the Vietnam Maritime Administration and the managers, operators, and operators to implement.

(7) With regard to maritime works for which the state capital component has been included in the enterprise, the enterprise assigned to manage and use the works shall perform the maintenance of the works in accordance with the provisions of the law on management and use of state capital invested in production and business at enterprises, specialized maritime legislation, and relevant laws.

(8) For maritime works managed by a unit under the Vietnam Maritime Administration

- Units under the Vietnam Maritime Administration assigned to manage and operate the works organize maintenance estimates for the following year and send them to the Vietnam Maritime Administration before June 30 every year;

- The Vietnam Maritime Administration appraises and approves the maintenance cost estimate for the following year, summarizes it, and submits it to the Ministry of Transport before August 15 every year for appraisal and allocation of capital for implementation;

- On the basis of the Ministry of Transport's decision on the assignment of state budget expenditure estimates, the units are responsible for organizing the annual maintenance according to regulations;

- The preparation and approval of cost estimates and maintenance shall comply with the provisions of current law.
