Content and specific expenditure of the Project to support production development and biodiversity conservation in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

1. Regulations on budgeting, payment, and settlement of expenditure for the implementation of the project on biodiversity conservation and development of poverty reduction models in Vietnam 

Based on Article 56 of Circular 55/2023/TT-BTC on regulations on budgeting, payment, and settlement of expenditure for the implementation of the project on biodiversity conservation and development of poverty reduction models:

- The budget for the implementation of the project on biodiversity conservation and development of poverty reduction models is built based on the support contents stipulated in Chapter V of Decree 27/2022/NS-CP (amended in Articles 11, 12, 13, and 14 of Decree 38/2023/NS-CP); point c, Clause 2, Section III of Decision 90/QS-TTg dated January 18, 2022; guidelines of the Ministry of Labor - Invalids and Social Affairs; corresponding support content and level as stipulated in Article 12 of Circular 55/2023/TT-BTC; and the current financial expenditure regime.

- For projects supporting the development of industries and services: In case the competent authority issues unit prices, the budget for the implementation of the project is based on the unit prices issued by the competent authority and the regulations in Clause 1, Article 56 of Circular 55/2023/TT-BTC.

- Support content, level, and method from the state budget for the implementation of one (01) project on biodiversity conservation and development of poverty reduction: Implement according to the provisions of Decree 27/2022/ND-CP (amended in Article 11, 12, 13, and 14 of Decree 38/2023/ND-CP); point c, Clause 2, Section III of Decision 90/QD-TTg dated January 18, 2022; guidelines of the Ministry of Labor - Invalids and Social Affairs, suitable for the conditions, characteristics, scale, objectives, tasks, and nature of each project on biodiversity conservation and development of poverty reduction, within the scope of the authorized budget.

- Payment and settlement of expenditure for the implementation of the project on biodiversity conservation and development of poverty reduction shall be carried out according to the provisions in Clause 3, Article 10 of Circular 55/2023/TT-BTC.

2. Content and specific expenditure of the Project to support production development and biodiversity conservation in Vietnam

According to Article 12 of Circular 55/2023/TT-BTC on the content and specific expenditure level of projects supporting production development and diversification:

- Expenditure on training and technical production, management training, contract management capacity, and group management and operation capacity for community production support, chain management, and market development for project participants: The content and expenditure level shall be carried out according to the provisions in Article 4, Clause 1 of Circular 55/2023/TT-BTC.

- Expenditure on technology transfer, application of new scientific and technical knowledge, application of technical processes in production and management, and synchronous quality control along the chain; promotion and commercialization of goods and services; support for analyzing food safety indicators, traceability costs, and labeling costs: The support level shall be determined by the competent authority approving the production development and diversification project within the scope of the project's support level and the authorized budget.

- Expenditure on community production development support, support for mission-oriented production development, and support for specific production development:

+ Direct support to staff members who provide advice and guidance to households until results are achieved:

++ Payment regime for staff members shall be in accordance with the provisions in Circular 40/2017/TT-BTC;

++ Support for staff members (in addition to the payment regime): maximum of 50,000 VND/person/field visit;

+ Expenditure on organizing field visits to study effective projects between localities, decided by the unit's leader within the allocated budget:

++ Payment regime for staff members, vehicle rental, meals, and accommodation (if applicable): Expenditure level in accordance with the provisions in Circular 40/2017/TT-BTC;

++ Payment for reporters: Expenditure level as specified in point a, Clause 2, Article 5 of Circular 36/2018/TT-BTC.

- Expenditure on support for materials, raw materials, plant varieties, livestock, fertilizers, animal health drugs, tools, equipment, and supplies for production and service supply: The content and support level shall be determined by the competent authority approving the production development and diversification project within the scope of support for one (01) approved project in accordance with the provisions in Clause 2, Article 3 and Clause 9, Article 4 of Circular 55/2023/TT-BTC.

- Expenditure on project construction and management: Implemented according to the provisions in Clause 13, Article 4 of Circular 55/2023/TT-BTC.

- Expenditure on vocational training, career guidance, market access, and job creation:

expenditure for support comes from related programs and projects. The support level shall be implemented according to the current regulations on vocational training, career guidance, market access, and job creation.
