Conditions on the competence of land surveying and assessment service providers in Vietnam according to Article 17 Decree 101/2024/ND-CP are as follows:
- A consultancy service provider can conduct land surveying and assessment when it meets one of the following conditions:
+ A public non-business unit with the function and task of performing land surveying and assessment services; must have at least one consultant meeting the conditions specified at Point a or Point b, Clause 2, Article 17 Decree 101/2024/ND-CP and at least two consultants meeting the conditions specified at Point c or Point d, Clause 2, Article 17 Decree 101/2024/ND-CP; may rent an analysis and testing laboratory that meets the conditions specified in Clause 3, Article 17 Decree 101/2024/ND-CP;
+ An enterprise registered for business in land surveying and assessment services; must have at least one consultant meeting the conditions specified at Point a or Point b, Clause 2, Article 17 Decree 101/2024/ND-CP and at least two consultants meeting the conditions specified at Point c or Point d, Clause 2, Article 17 Decree 101/2024/ND-CP; may rent an analysis and testing laboratory that meets the conditions specified in Clause 3, Article 17 Decree 101/2024/ND-CP.
- The leading consultant conducting provincial-level land surveying and assessment must have a university degree and at least 30 months of experience in one of the fields of soil science, agro-chemistry, environment, land management, and other related fields of land surveying and assessment, and must meet one of the following conditions:
+ Have led at least one project or task in nationwide or socio-economic region land surveying and assessment activities;
+ Have led at least three projects or tasks in provincial-level land surveying and assessment activities;
+ Have directly participated in at least one project or task in nationwide or socio-economic region land surveying and assessment activities;
+ Have directly participated in at least three projects or tasks in provincial-level land surveying and assessment activities.
- The unit conducting soil and water sample analysis must have an analysis laboratory licensed by a competent authority to operate for testing soil and water samples (excluding sampling activities) according to the provisions of law.
- The selection of a consultancy organization for land surveying and assessment will be carried out in accordance with the legal provisions on assigning tasks, placing orders or bidding to provide public service products using the state budget from regular operational funds.
Applications for collecting opinions, submission for appraisal, approval, publication, and storage of land surveying and assessment results according to Article 14 Decree 101/2024/ND-CP are as follows:
- Applications for collecting opinions
+ Written request for comments;
+ Summary report and map of land surveying and assessment results;
+ Data of land surveying and assessment results.
- Dossier for submission for appraisal of land surveying and assessment results
+ Submission for appraisal of land surveying and assessment results;
+ Summary report of land surveying and assessment results;
+ Map of land surveying and assessment results;
+ Data of land surveying and assessment results;
+ Report on the solicitation and settlement of comments on land surveying and assessment results.
- Dossier for approval submission
+ Submission for approval of land surveying and assessment results;
+ Summary report of land surveying and assessment results;
+ Map of land surveying and assessment results;
+ Data of land surveying and assessment results;
+ Report on the solicitation and settlement of appraisal comments on land surveying and assessment results.
- Dossier for publication of land surveying and assessment results
+ Decision on approval of land surveying and assessment results;
+ Summary report of land surveying and assessment results;
+ Map of land surveying and assessment results.
- Dossier for storage of land surveying and assessment results
+ One copy of Applications for storing nationwide and socio-economic region land surveying and assessment results specified at Point d, Clause 3, and Clause 4, Article 14 Decree 101/2024/ND-CP at the Ministry of Natural Resources and Environment of Vietnam;
+ One copy of Applications for storing provincial-level land surveying and assessment results specified at Point d, Clause 3, and Clause 4, Article 14 Decree 101/2024/ND-CP at the Ministry of Natural Resources and Environment of Vietnam, one copy at the Provincial People’s Committee, and one copy at the provincial land management agency.
