Regarding this issue, LawNet would like to answer as follows:

1. Conditions for upgrading the skill level of defense workers in Vietnam

The conditions for upgrading the skill level of defense workers in Vietnam, according to Article 6 of Decree 83/2016/ND-CP, are as follows:

- Must meet the conditions specified in clauses 2, 3, 4, 5, 6, 7, 8 of Article 6 of Decree 83/2016/ND-CP corresponding to each skill level, and must take the skill level assessment exam and achieve the required results.

- Defense workers who have the need are eligible to take the skill level assessment exam and be granted a skill level certificate of level 1 for a specific profession.

To be eligible to take the skill level assessment exam and be granted a skill level certificate of level 1 for a specific profession, defense workers must have a basic certificate or a professional certificate, a corresponding vocational certificate, or a technical worker certificate for the profession they are applying for and have at least 01 year of continuous work experience in that profession since obtaining the certificate.

- To be eligible to take the skill level assessment exam and be granted a skill level certificate of level 2 for a specific profession, defense workers must meet one of the following conditions:

+ Have a skill level certificate of level 1 or a basic certificate, a vocational certificate, or a technical worker certificate corresponding to the profession they are applying for and have at least 03 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have completed a vocational intermediate program, vocational secondary program, or vocational specialized program corresponding to the profession they are applying for.

- To be eligible to take the skill level assessment exam and be granted a skill level certificate of level 3 for a specific profession, defense workers must meet one of the following conditions:

+ Have a skill level certificate of level 2 or a graduation diploma from a vocational intermediate program, vocational secondary program, or vocational specialized program corresponding to the profession they are applying for and have at least 03 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 1 or a basic certificate, a vocational certificate, or a technical worker certificate corresponding to the profession they are applying for and have at least 06 years of continuous work experience in that profession since obtaining the certificate;

+ Have completed a higher education program corresponding to the profession they are applying for.

- To be eligible to take the skill level assessment exam and be granted a skill level certificate of level 4 for a specific profession, defense workers must meet one of the following conditions:

+ Have a skill level certificate of level 3 or a graduation diploma from a higher education program corresponding to the profession they are applying for and have at least 03 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 2 or a graduation diploma from a vocational intermediate program, vocational secondary program, or vocational specialized program corresponding to the profession they are applying for and have at least 06 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 1 or a basic certificate, a vocational certificate, or a technical worker certificate corresponding to the profession they are applying for and have at least 09 years of continuous work experience in that profession since obtaining the certificate;

+ Have completed a university program corresponding to the profession they are applying for.

- To be eligible to take the skill level assessment exam and be granted a skill level certificate of level 5 for a specific profession, defense workers must meet one of the following conditions:

+ Have a skill level certificate of level 4 or a graduation diploma from a university program corresponding to the profession they are applying for and have at least 06 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 3 or a graduation diploma from a higher education program corresponding to the profession they are applying for and have at least 09 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 2 or a graduation diploma from a vocational intermediate program, vocational secondary program, or vocational specialized program corresponding to the profession they are applying for and have at least 12 years of continuous work experience in that profession since obtaining the certificate or graduation diploma;

+ Have a skill level certificate of level 1 or a basic certificate, a vocational certificate, or a technical worker certificate corresponding to the profession they are applying for and have at least 15 years of continuous work experience in that profession since obtaining the certificate.

- To be eligible for evaluation and certification of vocational skills at level 6 in a profession, defense workers must meet one of the following conditions:

+ Have a level 5 vocational skills certificate corresponding to the profession being evaluated and have at least 6 years of continuous work experience in the profession since obtaining the certificate;

+ Have a level 4 vocational skills certificate or a university degree corresponding to the profession being evaluated and have at least 12 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 3 vocational skills certificate or a college degree, corresponding to the profession being evaluated, and have at least 15 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 2 vocational skills certificate or a vocational high school diploma, vocational high school degree, or vocational high school professional degree corresponding to the profession being evaluated, and have at least 18 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 1 vocational skills certificate or a basic certificate, vocational certificate, or technical worker certificate corresponding to the profession being evaluated, and have at least 21 years of continuous work experience in the profession since obtaining the certificate.

- To be eligible for evaluation and certification of vocational skills at level 7 in a profession, defense workers must meet one of the following conditions:

+ Have a level 6 vocational skills certificate corresponding to the profession being evaluated and have at least 6 years of continuous work experience in the profession since obtaining the certificate;

+ Have a level 5 vocational skills certificate corresponding to the profession being evaluated and have at least 12 years of continuous work experience in the profession since obtaining the certificate;

+ Have a level 4 vocational skills certificate or a university degree corresponding to the profession being evaluated and have at least 18 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 3 vocational skills certificate or a college degree, corresponding to the profession being evaluated, and have at least 21 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 2 vocational skills certificate or a vocational high school diploma, vocational high school degree, or vocational high school professional degree corresponding to the profession being evaluated, and have at least 24 years of continuous work experience in the profession since obtaining the certificate or degree;

+ Have a level 1 vocational skills certificate or a basic certificate, vocational certificate, or technical worker certificate corresponding to the profession being evaluated, and have at least 27 years of continuous work experience in the profession since obtaining the certificate.

2. Conditions for exemption from evaluation and recognition of skill level upgrade for defense workers in Vietnam

The conditions for exemption from evaluation and recognition of skill level upgrade for defense workers in Vietnam, according to Article 8 of Decree 83/2016/ND-CP, are as follows:

- Defense workers who have participated in the WorldSkills or ASEAN Skills Competition and achieved a medal are allowed to retain the results, be exempt from evaluation, and be considered for promotion of one skill level higher than their current skill level.

- Defense workers who have participated in the National Skills Competition and achieved a medal or have participated in the national-level Excellent Craftsmen Competition and achieved at least third place are allowed to retain the results, be exempt from evaluation, and be considered for promotion of their skill level one year earlier than the scheduled time.

- Defense workers who have participated in the national-level Excellent Craftsmen Competition and have been recognized as Excellent Craftsmen or have participated in the Excellent Craftsmen Competition organized by units under the Ministry of Defense and achieved at least third place are allowed to retain the results, be exempt from evaluation, and be awarded a vocational skills certificate when they reach the next level of skill promotion.

- The Minister of Defense shall determine cases where defense workers, during their time Haveing a skill level, have achieved outstanding performance in their tasks, and they will be considered for exemption from evaluation and awarded a vocational skills certificate when they reach the next level of skill promotion.
