Regarding this issue, LawNet would like to answer as follows:
According to Article 22 of Circular 24/2022/TT-BNNPTNT, in order to be recognized as an animal disease-free area, the following conditions must be met:
(1) Implement measures to prevent animal diseases that meet the corresponding provisions of the law on veterinary medicine, husbandry, or fisheries and the professional guidance of the Veterinary Authority.
- The breeding or aquaculture area shall be determined by the Veterinary Authority and proposed to the People's Committee of the registered location to recognize the animal disease-free zone in order to decide and direct the construction organization.
- Disease prevention, treatment, animal disease control, and quarantine of animals and animal products in the region must ensure adequate resources to control epidemics in accordance with veterinary medicine law.
- Before entering the animal disease-free zone, take control measures for animals, animal products, and means of transporting animals and animal products to reduce the risk of pathogens infecting and spreading in the region.
- Planing and organizing the implementation of biosecurity and disease response measures as prescribed in Articles 5 and 8 of Circular 24/2022/TT-BNNPTNT;
- Animal slaughterhouses, trading markets, and establishments that collect susceptible animals registered for disease safety recognition in the region must be supervised by the Veterinary Authority and comply with veterinary medicine law.
(2) Plan and organize the implementation of animal disease surveillance according to the provisions of Articles 6 and 7 of Circular 24/2022/TT-BNNPTNT.
(3) No outbreak of animal diseases: Comply with the provisions of Article 23 of Circular 24/2022/TT-BNNPTNT.
(4) Veterinary activities in the region shall comply with the provisions of Article 25 of Circular 24/2022/TT-BNNPTNT.
The assessment in the area registered for recognition of animal disease safety in Vietnam is carried out through the contents specified in Article 29 of Circular 24/2022/TT-BNNPTNT, specifically as follows:
- At the time of assessment, the delegation randomly selected a number of facilities in the region to evaluate the contents as prescribed in Clauses 1, 2 and 3, Article 16 of Circular 24/2022/TT-BNNPTNT and the biosecurity conditions of common areas in the region.
- Assess the level of compliance with the provisions of Articles 22, 23, and 25 of Circular 24/2022/TT-BNNPTNT.
- Check the management of information, data, and traceability systems as prescribed in Article 24 of Circular 24/2022/TT-BNNPTNT.
- During the assessment, if an animal shows signs of suspected disease or does not meet biosafety conditions, the assessment team will take samples for testing as prescribed at Point a or Point b, Clause 6, Article 7 of Circular 24/2022/TT-BNNPTNT.
- At the end of the inspection and assessment in the region, the assessment team:
+ Making a record according to the form in Appendix VIII (for areas registered for safety of terrestrial animal diseases), Appendix IX (for areas registered for animal rabies safety), or Appendix XI (for areas registered to be safe from aquatic animal diseases) promulgated together with Circular 24/2022/TT-BNNPTNT;
+ Notifying the assessment results to the People's Committee, and, at the same time, reporting the assessment results in writing to the leader of the veterinary agency;
+ Agreeing with the People's Committee on the time and content to correct errors in unsatisfactory cases.
- In cases of natural disasters, epidemics spreading to humans, or dangerous animal diseases, epidemics must be declared in accordance with the law on veterinary medicine: Comply with the provisions at Points a, b and c, Clause 6, Article 16 of Circular 24/2022/TT-BNNPTNT.
