Regarding this issue, LawNet would like to answer as follows:

1. Conditions for extending the service age of People's Public Security officers in Vietnam

Specifically, Article 14 of Decree 49/2019/ND-CP stipulates the conditions, time, competence, order, and procedures for extending the service age of People's Public Security officers who are professors, associate professors, doctors, and senior experts as follows:

- People's Public Security officers who are professors, associate professors, doctors, and senior experts may have their service age extended for teaching and scientific and technological research at higher education institutions. Research Institute in the People's Public Security.

- Officers specified in Clause 1 of Article 14 of Decree 49/2019/ND-CP may have their service age extended when fully meeting the following conditions:

+ Units directly employing officers have a shortage of staff compared to the assigned;

+ Having health, quality, and professional capacity and voluntarily continuing to work as required.

- Officers specified in Clause 1, Article 14 of Decree 49/2019/ND-CP may have their service age extended one or more times, each time not exceeding 02 years (24 months). The total length of time is as follows:

+ No more than 10 years for professors;

+ No more than 07 years for associate professors;

+ No more than 05 years for doctorates, senior experts.

- During the extension of service age, officers entitled to have the service age extended have the right to request to retire from work to enjoy the retirement regime as prescribed by law.

- The authority to extend the service age of officers who are professors, associate professors, doctors, and senior experts shall comply with relevant laws and be decided by competent agencies according to regulations on decentralization of personnel management.

- The Minister of Public Security shall prescribe the order and procedures for extending the service age of People's Public Security officers who are professors, associate professors, doctors, and senior experts.

2. Permissible age limits of non-commissioned officers and officers of the People's Public Security Force in Vietnam

Pursuant to Clause 1, Article 30 of the Law on People's Public Security Force 2018, the permissible maximum age limits of non-commissioned officers and officers of the People's Public Security Force shall be subject to the following regulations:

- Non-commissioned officers: 45;

- Company-grade officers: 53;

- Major and Lieutenant-Colonel: Male: 55; Female: 53;

- Senior Lieutenant Colonel: Male: 58; Female: 55;

- Colonel:  Male: 60; Female: 55;

- General-grade officers:  60.

3. Obligations and responsibilities of officers and non-commissioned officers of the People’s Public Security Force in Vietnam

Obligations and responsibilities of officers and non-commissioned officers of the People’s Public Security Force are specified in Article 31 of the Law on People's Public Security Force 2018 as follows:

- Show absolute loyalty to the Homeland, People and Communist Party and State.

- Strictly abide by the line of the Party, policies and laws of the State, regulations of the People’s Public Security Forces, and directives and orders of their superiors.

- Be honest, brave, vigilant and ready to fight and fulfill all assigned tasks.

- Respect and protect the lawful rights and interests of agencies, organizations and individuals; to maintain close contact with the People; to dedicatedly serve the People, to respect and be polite to the People.

- Regularly study to raise their political, legal, scientific-technical and professional levels; to temper their revolutionary quality, sense of organization and discipline and physical strength.

- Be answerable before law and their superiors for their own orders, the execution of their superiors’ orders and the performance by their subordinates.

Upon receipt of commanders’ orders, if having grounds to believe that such orders are unlawful, immediately report them to the persons who have issued the orders; if still having to obey the orders, bear no responsibility for the consequences of the execution of such orders.
