1. When is the Ethnic Minority Committee of the People's Council of a province, district, town or city established in Vietnam?

* Establishment of the Ethnic Minority Committee of the Provincial People's Council

According to Clause 3, Article 18 of the Law on Organization of Local Government 2015 (amended in 2019), the Provincial People’s Council shall establish the Legislation Committee, Economy - Budget Committee and Culture - Society Committee; as for ethnic minority province, the Ethnic Minority Committee shall be established. 

* Establishment of the Ethnic Minority Committee of the People's Councils of districts, towns and provincial cities:

According to Clause 3, Article 25 of the Law on Organization of Local Government 2015 stipulates that the district-level People’s Council shall establish the Committee on Legislation, Economy – Society; as for ethnic minority districts, the Committee on Ethnic Minority should be established.

Thus, the Ethnic Affairs Committee of the People's Council of a province, district, town or city is established when there are many ethnic minorities there.

2. Conditions for establishing the Ethnic Minority Committee of the Provincial People's Council in Vietnam

The criteria and conditions for establishing the Ethnic Minority Committee of the Provincial People's Council according to Article 1 of Resolution 1130/2016/UBTVQH13 are as follows:

- The Ethnic Minority Committee of the provincial People's Council shall be established when two of the following three criteria and conditions are met:

+ The province has over 20,000 ethnic minority people living in villages and hamlets;

+ The province has more than 5,000 ethnic minority people who are in need of the State's concentrated help and development support;

+ Provinces with ethnic minorities living in areas critical to security and defense; intercropping, interspersed areas; the border has a large number of ethnic minorities in our country and neighboring countries that often cross.

- For provinces where ethnic minorities live but do not meet the criteria and conditions for setting up the Ethnic Minority Committee specified in Clause 1, Article 1 of Resolution 1130/2016/UBTVQH13, the Society's Culture and Society Committee Provincial People's Councils perform tasks related to ethnic affairs.

3. Conditions for establishing the Ethnic Minority Committee of the People's Council of a district, town, or provincial city in Vietnam

Criteria and conditions for setting up the Ethnic Minority Committee of the People's Councils of districts, towns, and provincial cities according to Article 2 of Resolution 1130/2016/UBTVQH13 are as follows:

- The Ethnic Minority Committee of the People's Council of a district, town, or provincial city shall be established when one of the following two criteria and conditions are met:

+ Districts, towns, and provincial cities with more than 5,000 ethnic minority people who are in need of the State's focus on development assistance and support;

+ Districts, towns, and cities of provinces with ethnic minorities living in areas critical to security and defense; intercropping, interspersed areas; The border has a large number of ethnic minorities in our country and neighboring countries that often cross.

- For districts, towns, and provincial cities where ethnic minorities live but have not met the criteria and conditions for setting up the Committee for Ethnic Minorities specified in Clause 1, Article 2 of Resolution 1130/2016/UBTVQH13, the socio-economic committees of the People's Councils of the districts, towns, and provincial cities shall perform tasks related to ethnic affairs.

4. Regulations on responsibilities of Ethnic Minority Committee of the People's Council of a district, town, or provincial city in Vietnam

According to Article 108 of the Law on Organization of Local Government 2015, the areas in charge of the Committees of the People's Council are as follows:

- The Committee on Legislation managed by the People’s Council at the provincial, district and communal level shall be responsible for sectors such as enforcement of the Constitution and legislation, national defence, social security, order and safety, and local government construction and administrative division management affairs in this local area.

- The Committee on Culture – Society managed by the People’s Council at the provincial level shall be responsible for sectors such as education, healthcare, culture, society, information, physical exercise, sports affairs and policies on religion in this local area.

- The Committee on Economy – Budget managed by the provincial People’s Council shall be responsible for sectors such as economy, budget, urban, transportation, construction, science, technology, natural resources and environment affairs throughout the province.

- The Committee on Economy – Budget managed by the People’s Council of the centrally-governed city shall be responsible for sectors such as economy, budget, science, technology and natural resources affairs throughout the centrally-governed city.

- The Committee on Urban Affairs managed by the People’s Council of the centrally-governed city shall be responsible for sectors such as urban planning, technical and social infrastructural development, transportation, construction, environment and public service rendering affairs throughout the centrally-governed city.

- The Committee on Economy – Society managed by the People’s Council at the district and communal level shall be responsible for sectors such as economy, budget, urban, transportation, construction, education, healthcare, culture, society, information, physical exercise, sports, science, technology, natural resources, environment affairs and religious policies in this local area.

- The Committee on Ethnic Affairs managed by the People’s Council at the provincial and district level shall be responsible for the ethnic sector in this area.

- In case the People’s Council at the provincial and district level have not established the Committee on Ethnic Affairs, the Committee on Culture - Society managed by the People's Council at the provincial level, and the Committee on Economy – Society managed by the People’s Council at the district level shall be responsible for the ethnic sector in this area.
