1. Discharged non-commissioned officers and soldiers shall receive 100% of salary and allowances suitable during probation for officials and public employees in Vietnam

Specifically, under Clause 5, Article 8 of Decree 27/2016/ND-CP, discharged non-commissioned officers/ soldiers specified in Clause 1 Article 43 and Clause 1 Article 48 of the Law on Military Service 2015 shall be given priority in job provision and plus points in school recruitment or recruitment of officials and public employees; and shall receive 100% of salary and allowances suitable for their knowledge and skills during probation.

2. Demobilization Conditions in Vietnam in 2024

According to Article 43 of the Law on Military Service 2015, the conditions for demobilization in Vietnam are as follows:

- Non-commissioned officers and soldiers who have completed the service term specified in Clauses 1 and 2, Article 21 of the Law on Military Service 2015, which include:

+  The  service  term  in  peacetime  for  non-commissioned  officers  and  soldiers  is  24  months.

+  The  Minister  of  Defense  may  decide  to  extend  the  service  term  of  non-commissioned  officers  and  soldiers,  but  not  exceeding  6  months  in  the  following  cases:       

++  To  ensure  combat  readiness;       

++  While  performing  tasks  of  disaster  prevention  and  control,  epidemic  prevention,  rescue,  and  relief.

- Non-commissioned officers and soldiers on active duty may be demobilized before the term if a Military Medical Board concludes they are not fit to continue service or in cases specified in points b and c of Clause 1, and points a, b, and c of Clause 2, Article 41 of the Law on Military Service 2015.

3. Percentage of Salary for officials on probation in Vietnam

Based on Article 22 of Decree 138/2020/ND-CP, policies for officials on probation and their mentors are prescribed as follows:

- During the probationary period, the probationer receives 85% of the salary of grade 1 of the recruitment grade. If the probationer holds a master's degree suitable for the job position, they will receive 85% of the salary of grade 2 of the recruitment grade; if the probationer holds a doctoral degree suitable for the job position, they will receive 85% of the salary of grade 3 of the recruitment grade. Allowances are granted in accordance with the law.

- The probationer will receive 100% of the salary and allowances for the recruitment grade corresponding to their educational qualifications as prescribed in Clause 1, Article 22 of Decree 138/2020/ND-CP in the following cases:

+  Working  in  areas  with  exceptionally  difficult  socioeconomic  conditions;

+  Working  in  hazardous  and  dangerous  fields;

+  Completed  military  service,  served  in  the  People's  Public  Security,  as  army  officers,  police  officers,  professional  soldiers  demobilized  and  shifted  to  civilian  roles,  students  graduating  from  reserve  officer  training,  local  military  command  chief  training  who  have  been  conferred  reserved  officer  ranks  and  registered  as  reserve  officers,  members  of  the  youth  volunteer  force,  and  young  intellectuals  volunteering  for  rural  and  mountainous  development  for  at  least  24  months  and  having  completed  their  tasks.

- The probationary period will not be counted towards the promotion period.

- Officials assigned by their agencies or organizations to guide probationers will receive a responsibility allowance coefficient of 0.3 compared to the statutory pay rate during the probationary guidance period.
