1. Conditions and methods of conducting electronic transactions in social insurance in Vietnam

Conditions and methods of conducting electronic transactions in social insurance in Vietnam as per Article 5 of Decree 166/2016/ND-CP are as follows:

- Agencies, organizations, and individuals conducting electronic transactions in the field of social insurance must ensure the following conditions:

+ Have a valid digital certificate issued by a service provider that certifies digital signatures according to legal regulations.

In cases where individuals conduct electronic transactions in the field of social insurance but have not been issued a digital certificate, they can use the electronic transaction authentication code provided by Vietnam Social Security.

+ Have the capability to access and use the Internet; have a stable email address and register with Vietnam Social Security.

- Agencies, organizations, and individuals participating in electronic transactions in the field of social insurance can choose to conduct electronic transactions directly through the Vietnam Social Security portal or via I-VAN Organization as stipulated in Decree 166/2016/ND-CP.

2. Obligations of participants in electronic transactions in social insurance in Vietnam

Obligations of participants in electronic transactions in social insurance as per Article 13 of Decree 166/2016/ND-CP are as follows:

- Create, send, and receive electronic social insurance documents directly at the Vietnam Social Security portal or via I-VAN Organization.

- Not conduct transactions using paper records for procedures registered electronically during the period of electronic transactions, except as stipulated in Clause 7, Article 13 of Decree 166/2016/ND-CP.

- Manage digital signatures and ensure the accuracy of digital signatures on electronic social insurance documents; manage the name and password of the electronic transaction account in the field of social insurance to ensure the safety and confidentiality of information on the I-VAN Organization’s electronic data exchange system and the information technology system of Vietnam Social Security.

- Store and ensure the integrity of all electronic social insurance documents as per legal regulations on archiving, electronic transactions, social insurance, health insurance, unemployment insurance, and related laws, except in the case of individuals participating in electronic transactions in the field of social insurance.

- Store paper documents according to legal regulations on archiving for documents declared to the social insurance authorities but not yet converted to electronic documents; present them when the competent authorities cross-check and inspect.

- Implement safety and security regulations for the electronic data exchange system of the I-VAN Organization and the information technology system of Vietnam Social Security.

- Create paper social insurance records or convert electronic social insurance records to paper social insurance records to submit to the directly managing Social Insurance agency no later than 3 working days from the date of the submission deadline for social insurance, health insurance, unemployment insurance contributions in cases where electronic social insurance records are due for submission but the electronic data exchange system and technical infrastructure have not resolved the issues; no later than 7 working days from the submission deadline for other transactions.

Once the issue is resolved, agencies, organizations must send the electronic social insurance records to the Vietnam Social Security portal or the chosen I-VAN Organization.

- Fulfill the contractual terms with the I-VAN Organization.

- Comply with inspections, checks, and cross-examinations by competent state agencies regarding the implementation of social insurance, health insurance, unemployment insurance as per legal regulations.

- Take responsibility for declaring electronic social insurance documents in accordance with legal regulations on electronic transactions, social insurance, health insurance, unemployment insurance, occupational safety, and related laws.

- Fulfill other obligations as prescribed by law.
