Conditions and application for conversion from a university into a parent university in Vietnam

1. Conditions for conversion from a university into a parent university in Vietnam

According to Clause 1, Article 4 of Decree 99/2019/ND-CP, the conditions for conversion from a university into a parent university in Vietnam are as follows:

- The university must be recognized for meeting higher education quality standards by a legitimate educational quality accreditation organization;

- There must be at least three constituent schools established under Clause 4, Article 4 of Decree 99/2019/ND-CP; at least 10 doctoral level training programs; a regular enrollment scale of over 15,000 students;

- For public universities, consent from the direct managing authority is required; for private universities, at least 75% consensus from the investors representing the total contributed capital is needed, particularly in non-profit private universities.

2. Application for conversion from a university into a parent university in Vietnam

According to Clause 2, Article 4 of Decree 99/2019/ND-CP, the dossier for conversion from a university into a parent university in Vietnam includes:

- A proposal to transition the university to a parent university; a resolution of the university council;

- A scheme outlining the transition of the university to a parent university, detailing the necessity, evidence specified in Clause 1, Article 4 of Decree 99/2019/ND-CP; a draft regulation on the organization and operation of the parent university; solutions to address risks during the transition (if any); impact assessment on personnel, finances, assets, and handling methods.

3. Procedure for processing the application for conversion from a university into a parent university in Vietnam

The procedure for processing the application for conversion from a university into a parent university in Vietnam according to Clause 3, Article 4 of Decree 99/2019/ND-CP is as follows:

- The university submits one dossier directly or via postal mail accompanied by a soft copy to the Ministry of Education and Training or via the online public service on the Ministry's electronic portal;

- Within 30 working days from the day of receiving a complete dossier as stipulated in this Article, the Ministry of Education and Training organizes the dossier appraisal and submits it to the Prime Minister of the Government of Vietnam for a decision;

- If the dossier does not meet the requirements, within 10 working days from the day of receiving the dossier, the Ministry of Education and Training sends a written notice to the university specifying the reasons.

4. Regulations on connecting universities to establish a parent university in Vietnam

The regulations on connecting universities to establish a parent university according to Article 5 of Decree 99/2019/ND-CP are as follows:

- The conditions for connecting universities to establish a parent university are as follows:

+ There must be at least 3 universities of the same public type or the same private type linking to form a parent university or at least 3 universities involving private universities and non-profit private universities linking to form a non-profit private parent university;

+ There must be a draft regulation on organization and operation of the parent university constructed by the linked universities, which identifies the common goals and mission; regulations on organization, finance, assets; other contents (if any);

+ Approval from the direct managing authority of public universities or consensus from the investors representing at least 75% of the total contributed capital in each private university, non-profit private university.

- The dossier for linking universities to form a parent university includes:

+ A joint proposal requesting the formation of the parent university by the participating universities;

+ Resolutions from the university councils regarding participation in the linking;

+ A scheme for the linking to form a parent university, detailing the necessity, changes in goals, mission of the participating universities; a draft regulation on the organization, operation of the university; solutions to manage risks during linking (if any).

- The procedure for processing the dossier is as follows:

+ The university representing the participating universities submits one dossier directly or via postal mail accompanied by a soft copy to the Ministry of Education and Training or via the online public service on the Ministry's electronic portal;

+ Within 45 working days from the day of receiving a complete dossier as stipulated in Article 5 of Decree 99/2019/ND-CP, the Ministry of Education and Training presides over and cooperates with relevant ministries and central authorities to organize the dossier appraisal and submit it to the Prime Minister of the Government of Vietnam for a decision;

+ If the dossier does not meet the requirements as stipulated in Article 5 of Decree 99/2019/ND-CP, within 10 working days from the day of receiving the dossier, the Ministry of Education and Training sends a written notice to the universities specifying the reasons.
