Composition and uses of cadastral records in Vietnam under the new Land Law

According to Article 129 of the Land Law 2024, cadastral records include documents detailing individual parcels, land managers, land users, owners of assets attached to the land, legal status of parcels and attached assets, reflecting comprehensively the management and use of land in a given area.

Cadastral records are compiled digitally, comprising the following documents:

- Cadastral maps;

- Land registry books;

- Cadastral books;

- Copies of various certificates, including: Certificate of land use rights, Certificate of ownership of residential housing and land use rights, Certificate of house ownership, Certificate of ownership of construction works, Certificate of land use rights, ownership of housing and other assets attached to the land, Certificate of land use rights, ownership of assets attached to the land.

Cadastral records are used for the following purposes:

- As a tool for land management;

- Protecting rights and determining obligations of land users, land managers, owners of assets attached to the land, organizations, and individuals involved according to land law regulations;

- Determining financial revenue from land;

- Monitoring changes in the land use rights market;

- Supporting land users in accessing credit funds;

- Assisting sectors and levels in directing, managing, constructing, implementing, and monitoring the execution of planning and infrastructure development;

- Providing information to competent authorities in resolving disputes related to land use rights and assets attached to the land;

- Providing information to organizations and individuals needing land access.

Regulations on the content of cadastral records in Vietnam

According to Article 6 of Circular 10/2024/TT-BTNMT, the current information in cadastral records in Vietnam is as follows:

(1) Information about parcels and linear geographical objects, including:

1.1) Serial number;

1.2) Address;

1.3) Boundaries;

1.4) Area;

1.5) Land type;

1.6) Mode of land use;

1.7) Land use duration;

1.8) Land use origin;

1.9) Information about financial obligations;

1.10) Information about restrictions on land use rights, rights concerning adjacent parcels (if any);

1.11) Information about surveying documents.

(2) Information about assets attached to the land, including: asset name, asset characteristics, ownership form, ownership duration, asset address, restrictions on asset rights.

(3) Information about land users, owners of assets attached to the land, persons assigned land for management.

(4) Information about the status of land use rights, ownership rights of assets attached to the land, rights to land assigned for management.

(5) Information about changes in land and assets attached to the land.

(6) Presentation of information in the components of cadastral records as follows:

- Information stipulated at points 1.1, 1.4, and 1.5 under (1) is presented in cadastral maps, land registry books, and cadastral books;

- Information stipulated at point 1.3 under (1) is presented in cadastral maps;

- Information stipulated at points 1.2, 1.6, 1.7, 1.8, 1.9, 1.10, and 1.11 under (1) and in (2), (4), and (5) is presented in cadastral books;

- Information stipulated in (3) is presented in land registry books and cadastral books;

- The information stipulated in this Article is specifically presented in Articles 8, 9, 10, 11, 12, and 13 of Circular 10/2024/TT-BTNMT.
