Regarding this issue, LawNet would like to answer as follows:
Regulations on the management of costumes, identity cards, and certificates of legal titles of the People's Procuracy in Vietnam according to Article 10 of the Regulation promulgated together with Decision 54/QD-VKSTC-V9 dated February 21, 2013 are as follows:
- Cadres, civil servants, and public employees are not allowed to use the people's procuratorate uniform, identity card, or certificate of legal title for self-interest or for private purposes;
The identity card, certificate of legal title must not be used instead of the introduction letter, citizen identity card, or other personal papers; not allow others to borrow costumes, identity cards, or certificates of legal titles;
Not using the provided costumes as gifts or gifts for others.
- Cadres, civil servants, and public employees who lose their identity cards, certificates of legal titles must immediately report to the nearest police agency and report to the director of the procuracy or the head of the agency where they are working.
- Cadres, civil servants, and public employees who lose their badges must report them to the Procurator General or the head of the unit where they are working.
In case of granting, changing, and revoking the identity card and legal title certificate of the People's Procuracy according to Article 12 of the Regulations promulgated together with Decision 54/QD-VKSTC-V9 dated February 21, 2013, as follows:
- Badges, badges or identity cards, or certificates of legal titles are lost or damaged, officials, civil servants, and public employees must file a report and request re-issuance.
The Supreme People's Procuracy shall only consider re-issuance after the cadre, civil servant, or public employee has submitted a report that contains the certification and proposal of the Chief Procurator of the provincial-level People's Procuracy or the head of the unit directly under the Supreme People's Procuracy.
- Procurators, deputy heads of procuracies, heads and deputy heads of investigating bodies, procurators, investigators, and inspectors at all levels who are appointed to ranks or titles higher or lower than their current rank;
Being transferred from one local People's Procuracy to another, from one Military Procuracy to another (not at the same level, to another province or military zone or service), from the local People's Procuracy to the Supreme People's Procuracy;
And vice versa, they must return the current identity card, certificate of legal title and be exchanged for a new identity card or certificate of legal title according to the rank or title appointed.
- For cadres, civil servants, and public employees when transferring to another agency or unit or being dismissed from duty
must return their badges, badges, identity cards, and certificates of legal titles to the head of the local People's Procuracy or the head of the unit where they work when there is a decision.
- The director, deputy director, heads and deputy heads of the investigating bodies, the procurators, investigators, and examiners who are entitled to retire according to the retirement regime must return their identity cards and certificates of legal title to the local People's Procuracy, the unit where they work, upon receiving the decision.
- The director, deputy director, heads and deputy heads of the procuracies, investigating bodies, procurators, investigators, and examiners are dismissed from their positions;
Or forced to quit their jobs, they must return their badges, identity cards, and certificates of legal titles to the local procuracy, the unit where they work, when there is a decision on dismissal or forced resignation.
- Cadres, civil servants, and other public employees who do not hold legal titles and are forced to quit their jobs must return their badges and insignia to the local People's Procuracy or the unit where they work when there is a decision on forced resignation.
