Regarding this issue, LawNet would like to answer as follows:

1. What are the standards for professional titles of civil servants?

According to Article 28 of Decree 115/2020/ND-CP regulating professional title standards for public employees, the following contents are included:

- Name of professional title;

- Tasks include specific tasks that must be performed with a level of complexity appropriate to the occupational title class;

- Standards of professional ethics;

- Standards for training and fostering qualifications;

- Standards of professional capacity and professionalism.

Based on the job complexity of the occupational title, civil servant occupational titles in the same career field are ranked from high to low as follows:

- Class I professional title;

- Class II professional title;

- Class III professional title;

- Occupational title class IV;

- Class V professional title.

2. Cases where professional titles must be changed in Vietnam

Article 29 of Decree 115/2020/ND-CP clearly states that changing professional titles for public employees is done in the following cases:

- Consider switching from one professional title to another corresponding to the same level of job complexity as required by the job position;

- Examination or consideration for promotion of a professional title from a lower rank to an adjacent higher rank in the same occupational field;

- Consider special promotion to a higher professional title class corresponding to the recognized and appointed title according to the provisions of specialized law.

Thus, changing the professional title of public employees is carried out in the above cases.

3. Is it necessary to change the professional title when changing job position in Vietnam?

According to the provisions of Article 30 of Decree 115/2020/ND-CP on considering professional title transfer as follows:

- The consideration of changing professional titles is carried out when an employee changes a job position and the current job title does not match the requirements of the new job position.

- Officials considered for the transfer of professional titles must meet the criteria for the transferred professional titles.

- The head of the public service unit decides or requests the competent authority to decide on the consideration of transferring professional titles according to decentralized authority.

Note: When considering changing professional titles, do not consider increasing salary levels.

Thus, when an employee changes a job position, he or she can change his/her professional title if the current job title does not match the requirements of the new job position. At the same time, public employees must meet the standards for the transferred professional title. Changing professional titles does not incorporate salary increases.

4. Application for exam registration or consideration for professional title promotion in Vietnam

Dossier to register for the exam or consider professional title promotion includes:

- The civil servant's curriculum vitae, according to current regulations, must be prepared no later than 30 days before the final deadline for submitting exam applications or considering promoting professional titles, with confirmation from the agency or unit employing the public employee;

- Comments and assessments of the head of the public service unit employing public employees or of the head of the agency competent to manage the public service unit on the standards, conditions for registering for exams, or considering promotion of professional titles of civil servants according to regulations;

- Copies of diplomas and certificates as required by the professional title exam or promotion consideration;

In case the officer has a professional diploma with standardized output in foreign languages and information technology according to regulations, if it corresponds to the requirements of the professional title taking the exam or being considered for promotion, it can be used to replace foreign language and information technology certificates;

In cases where public employees are exempted from taking foreign language and computer science exams as prescribed in Clauses 6 and 7 of Article 39 of Decree 115/2020/ND-CP, they will be exempt from foreign language certificates and computer science certificates;

- Other requirements as prescribed by professional title standards for examination or promotion consideration.
