Regulations on deadline for changing the current license plates to the plates with yellow background in Vietnam

According to Clause 2, Article 26 of Circular 58/2020/TT-BCA, vehicles engaged in commercial transport operations before August 1, 2020 are required to switch to yellow license plates with black letters and numbers before December 31, 2021.

The deadline for individuals and organizations in commercial transport to complete the procedure for changing plates is before December 31, 2021.

Penalties for vehicles operating in transport business that do not change their current license plates to the plates with yellow background as prescribed in Vietnam

From 2022, vehicles operating in transport business that do not switch to yellow license plates with black letters and numbers will be penalized according to point đ clause 7 Article 30 of Decree 100/2019/ND-CP. Specifically:

A fine of from VND 2,000,000 to VND 4,000,000 for individuals, from VND 4,000,000 to VND 8,000,000 for organizations who are owners of cars, tractors, special-use vehicles, and other vehicles similar to cars that do not comply with regulations on license plates and writing on the sides of cars and doors, except for the following violations:

- Operating vehicles without license plates (for types of vehicles required to have license plates); operating vehicles with license plates that do not match the vehicle registration certificate or with license plates not issued by competent authorities (including trailers and semi-trailers).- Other violations related to not posting or inaccurately posting the name and telephone number of the commercial transport business unit according to points a, b, c, d, dd clause 2 Article 28 Decree 100.- Driving training institutions using training vehicles without a "Driver Training Vehicle License" or with expired licenses, not attaching "Driver Training" plates on vehicles as prescribed, not marking the training institution name and telephone number on the outside of both doors or both sides of the vehicle as prescribed.

Thus, there are only 06 months left for commercial vehicle owners to complete the procedure for changing their vehicles operating in transport business' license plates to license plates with yellow background according to regulations. Starting from 2022, vehicles operating in transport business that do not switch to license plates with yellow background will be fined from VND 2,000,000 to VND 4,000,000 (for individuals) and from VND 4,000,000 to VND 8,000,000 (for organizations).

Procedure for changing the current license plates to the plates with yellow background as prescribed in Vietnam

- Vehicles operating in transport business already registered with white plates, black letters, and numbers should submit 01 application for changing the license plate to the Traffic Police Department, Railway – Road Traffic Police Department, or the Traffic Police Department of the provincial/city police agencies (referred to as the Traffic Police Department).

- The license plate change will be processed immediately upon receiving a valid vehicle registration application (clause 1 Article 4, Circular 58/2020/TT-BCA).

Document components

As stipulated in Articles 7, 9, 11 of Circular 58/2020/TT-BCA, include:

- Vehicle registration declaration form.

- Vehicle registration certificate.

- Old license plate.

- Identity card or Citizen ID card or household registration book of the vehicle owner. For Vietnamese residing abroad, a valid passport may be presented.

For authorized representatives handling the vehicle registration procedures, in addition to the owner’s documents above, they must also present a valid Citizen ID card, Identity card, diplomatic ID, or public service ID card.

Charges for changing vehicle registration with license plate

As stipulated in Article 5, Circular 229/2016/TT-BTC, specifically:

- VND 150,000 for cars.

- VND 100,000 for trailers, semitrailers registered separately.

- VND 50,000 for motorcycles.
