Regarding this issue, LawNet responded as follows:

1. Subjects to be considered for civil servant recruitment in Vietnam 2023

According to Article 10 of Decree 138/2020/ND-CP, the recruitment of civil servants through recruitment examination is decided by the agency competent to recruit civil servants and is performed separately for each of the following groups of subjects:

- Persons who commit to volunteering to work for 5 years or more in areas with extremely difficult socio-economic conditions;

- Learners under the recruitment regime according to the provisions of the Education Law 2019, after graduating, work in the locality where they are sent to study;

- Excellent graduates, talented young scientists.

2. Basis to determine the successful candidate in the civil service recruitment exam in Vietnam

Specifically, in Clause 1, Article 12 of Decree 138/2020/ND-CP, the successful candidate in the civil servant recruitment examination must fully meet the following conditions:

- Having the second round score of 50 points or more;

- Having a result of round 2 plus priority points specified in Article 5 of Decree 138/2020/ND-CP (if any) is higher, in order of points from highest to lowest.
within the recruitment quota of each job position.

Specific regulations on subjects and priority points in admission are as follows:

+ Heroes of the Armed Forces, Heroes of Labor, War Invalids, and beneficiaries of policies such as Class B War Invalids and War Invalids: 7.5 points will be added to the second round score;

+ Ethnic minority people, military officers, police officers, professional servicemen, people doing cipher work changing branches, graduates of reserve officer training, and commanders of commune-level military commands of grassroots military branches are conferred the rank of reserve officer, son of martyrs. , children of war invalids, children of sick soldiers, children of policy beneficiaries such as war invalids, children of class B invalids, children of resistance activists infected with toxic chemicals, hero of the Armed Forces, hero of labor: 5 points will be added to the 2nd round score;

+ Those who have completed their military service, the obligation to join the People's Police, and volunteer youth members: 2.5 points will be added to the second round score.

In the event that the candidate belongs to many priority categories as prescribed above, only the highest priority score will be added to the result of round 2.

In case there are 02 or more people with the same total score as prescribed at Point b, Clause 1, Article 12 of Decree 138/2020/ND-CP in the final criterion of the job position to be recruited, the person who has a higher score in round 2 is the one who is admitted;

If it is still undetermined, the head of the agency competent to recruit civil servants shall decide on the successful candidate.

3. Bases for recruitment of civil servants through recruitment examination in Vietnam

The basis for recruitment of civil servants through the recruitment examination prescribed in Article 3 of Decree 138/2020/ND-CP is specifically as follows:

- The recruitment of civil servants must be based on task requirements, job positions, and staffing quotas.

- Agencies competent to recruit civil servants shall develop recruitment plans and report them to civil servant management agencies for approval as a basis for recruitment before each recruitment period. The contents of the recruitment plan include:

+ The number of civil servant payrolls assigned by a competent authority and the number of unused payrolls of the agency employing the civil servant;

+ Number of staff to be recruited for each job position;

+ Number of job vacancies to be recruited for ethnic minorities (if any), in which clearly defined criteria and ethnic structure are to be recruited;

+ Number of job positions to be recruited (if any) for each target group: People who commit to volunteering to work for 5 years or more in areas with extremely difficult socio-economic conditions; learners according to the recruitment regime according to the provisions of the Education Law 2019, after graduating to work in the locality where they are sent to study; excellent graduates, talented young scientists;

+ Standards and conditions for applying for each job position;

+ The form and content of the entrance examination or examination;

+ Other contents (if any).

- The recruitment plan when applying for a group of excellent graduates and talented young scientists to implement
according to the Government's regulations on the policy of attracting and creating cadres from excellent graduates and young scientists.
