The following article contains information regarding the basis for imposition of charges for use of wharves, docks and mooring buoys at Vietnamese Seaports, as newly regulated in Circular 39/2023/TT-BGTVT.

According to the provisions of Article 14 of Circular 39/2023/TT-BGTVT, the basis for imposition of charges for use of wharves, docks and mooring buoys at Vietnamese Seaports is as follows:
- Ships and boats berthing or mooring at multiple locations within the waters and maritime areas of a seaport will have their bridge, wharf, and buoy service charges calculated based on the total actual berthing or mooring time at each location.
- In cases where ships and boats cannot conduct loading and unloading due to weather conditions for a period exceeding 1 day (24 consecutive hours) or must give way to other vessels by order of the Maritime Authority Director, the bridge, wharf, and buoy service charges will not be calculated for the duration of non-operations.
- For vessels not specialized for serving the oil industry entering oil service ports for loading, the pricing will apply as specified in points 1, 2, 3, 4, 5 of Section I, II Article 12 and points 1, 2, 3, 4, 5 of Section I, entire Section II of Article 13 of Circular 39/2023/TT-BGTVT.
- Gross Tonnage (GT) is one of the basic units for calculating bridge, wharf, and buoy service charges, categorized as follows:
+ For liquid cargo ships: total tonnage is calculated as 85% of the maximum GT stated in the certificate issued by the registration authority for the vessel, regardless of whether the ship has ballast tanks.
+ For passenger ships: total tonnage is calculated as 100% of the maximum GT stated in the certificate issued by the registration authority for the vessel.
- The pricing framework for passenger services through bridges, wharfs, and buoys as prescribed in Article 14 of Circular 39/2023/TT-BGTVT does not apply to children under 12 years of age.
The pricing framework for the use of bridges, wharfs, and buoys within maritime areas for ships, cargo, and passengers engaged in international transport at Vietnamese Seaports as stipulated in Article 13 of Circular 39/2023/TT-BGTVT is as follows:
