The basis for the formulation and implementation of the provincial housing development program and plan in Vietnam according to Article 26 of the Housing Law 2023 is as follows:
- The basis for formulating provincial housing development programs includes:
+ National housing development strategy;
+ Land use planning, construction planning, urban planning;
+ Local socio-economic development conditions; results of the previous provincial housing development program; current housing conditions; housing demand during the period of formulating the provincial housing development program.
- The basis for formulating provincial housing development plans includes:
+ Provincial housing development program;
+ Local socio-economic development plan;
+ Results of the previous provincial housing development plan; current housing conditions; housing demand during the period of formulating the provincial housing development plan.
- Based on local conditions, the provincial People's Committee may formulate and approve separate plans for social housing development, housing for resettlement, rebuilding, and renovation of apartment buildings.
- The period for provincial housing development programs and plans is determined as follows:
+ The period for the provincial housing development program is 10 years, corresponding to the period of the national housing development strategy;
+ The period for the provincial housing development plan is 05 years, with the first period aligning with the start of the provincial housing development program.
The details of provincial housing development programs and plans according to Article 27 of the Housing Law 2023 are as follows:
- The content of the provincial housing development program includes:
+ Assessment of the current status regarding floor area and quality of individual houses and apartment buildings; current status of housing types developed through projects, housing under national target programs, public investment programs on housing, housing constructed by individuals; current status of the housing real estate market;
+ Analysis and evaluation of achievements, existing issues, difficulties, obstacles, and reasons for the implementation of the previous provincial housing development program;
+ Estimating the land area for developing social housing, housing for resettlement, official accommodation, rebuilding, and renovating apartment buildings. Estimating the total additional floor area of housing needed in the province or centrally administered city during the provincial housing development program period, detailing the housing area needed for each group entitled to social housing policy support, and each type of housing developed through projects;
+ Defining general and specific objectives for housing development in the province or centrally administered city;
+ Orienting development targets during the program period, including average housing area per capita in urban and rural areas and across the province or centrally administered city; minimum floor area; anticipated floor area to be completed and put into use during the program period; housing quality in urban and rural areas;
+ Determining the need for state budget and other capital sources for housing development;
+ Measures to implement the program, including measures related to planning, land fund, financing, tax, administrative procedure reform, investment procedures, and other measures;
+ Areas expected to develop housing categorized by district-level administrative units;
+ Responsibilities of the People's Committees at various levels and local regulatory agencies in implementing the provincial housing development program.
- The content of the provincial housing development plan includes:
+ Targets for average housing area per capita, completed and usable floor area for various types of housing developed through projects, housing under national target programs, public investment programs on housing;
+ Targets for housing quality in urban and rural areas in the province or centrally administered city;
+ Need for state budget and other capital sources for housing development;
+ Measures to implement the plan according to the national housing development strategy and provincial housing development program;
+ Responsibilities of the People's Committees at various levels and local regulatory agencies in implementing the provincial housing development plan.
