Regarding this issue, LawNet answers as follows:

1. Basis and content of appraisal of quality and amount of works and products in the field of land management in Vietnam

The basis and content of the appraisal of the quality and amount of works and products in the field of land management according to Article 15 of Circular 49/2016/TT-BTNMT are as follows:

* Basis for appraisal

- Records of inspection of quality, amount of work, and products at the construction unit level;

- Documents examining the quality and amount of works and products at the investor level;

- Completed products and other related documents (if any).

* Content and time of appraisal

Within no more than 10 working days from receipt of complete and valid documents, the investor is responsible for completing the appraisal of the project item or the entire project and product. For programs, schemes, projects, technical designs - estimates, complex tasks, and large product amounts, the appraisal time may be extended, but not more than 20 working days. Appraisal content includes:

- Appraise compliance with the content of programs, schemes, projects, technical designs - estimates, tasks approved by competent state agencies, and other related technical documents;

- Evaluate compliance with regulations on construction supervision, quality, and quantity inspection of works and products;

- Appraise the handling of arising problems during the construction process by the construction unit, supervision and inspection unit, investor, and investment decision agency (if any);

- Appraise the quality, amount, and difficulty level (if any) of work items or entire works and products implemented. In cases of necessity, quality, amount, and difficulty level can be rechecked based on a number of product samples;

- Request relevant units to correct, supplement, and complete documents and products when the products do not meet the requirements, the difficulty level is not appropriate, and the documents have errors (if any);

- Prepare a report on the appraisal of the quality and amount of works and products according to Form No. 08, Appendix 02, issued with Circular 49/2016/TT-BTNMT.

2. Principles of supervision, inspection, appraisal, and acceptance of works and products in the field of land management in Vietnam

Principles for supervision, inspection, appraisal, and acceptance of works and products in the field of land management according to Article 4 of Circular 49/2016/TT-BTNMT are as follows:

- Supervision, inspection, appraisal, and acceptance of projects and products must be carried out regularly and systematically during the implementation process, based on the supervision, inspection, appraisal, and acceptance plan established according to the construction progress of each item or the entire project or product.

- The investor, using an affiliated unit or hiring a supervision and inspection unit with appropriate functions (hereinafter referred to as the supervision and inspection unit), shall carry out supervision and inspection of projects and products at the investor level.

- Construction organizations and individuals (hereinafter referred to as construction units) of works and products must self-inspect and accept the quality and quantity of all work items and products before inspection and acceptance by the competent authority.

- During construction, if there are changes in salary policies and economic-technical norms, the monitoring and inspection process must specifically determine the amount of work items performed before and after the time the salary policy and economic-technical norms change.
