1. Authority to discipline violating party members in Vietnam

The authority to discipline party members for violations according to Article 36 of the Charter of the Communist Party of Vietnam 2011 is as follows:

- Party cell decides to reprimand and warn party members in the cell (including party committee members at all levels and party members under the management of superior party committees) for violating political qualities, ideology, ethics, lifestyle, party activities, and performing party member duties (except duties assigned by superiors).

The grassroots Party Committee decided to reprimand and warn party members in the party committee and dismiss lower-level committee members.

The grassroots Party Committee that is authorized to decide to admit party members has the right to decide to expel party members, but they are not members of the same level, and party members are officials under the management of the superior party committee.

- Party committees of provinces, cities, districts, and equivalent levels decide on forms of discipline for party members; decide to reprimand and warn party committee members at all levels and party members under management of superior party committees for violating political qualities, ideology, ethics, lifestyle, party activities, and performing party member duties; decide to reprimand and warn members of the same level for violating the tasks assigned by the Party Committee.

The Standing Committee of the Party Committee decides on forms of discipline for party members; and decides to reprimand and warn party committee members at all levels and party members under the management of superior party committees for violating political qualities, ideology, ethics, lifestyle, party activities, and performing tasks of party members and officials under the management of superior party committees that violate assigned professional tasks.

- The Central Executive Committee decides on forms of discipline for party members, including members of the Central Executive Committee, members of the Secretariat, and members of the Politburo.

The Politburo and the Secretariat decide on forms of discipline for party members, including party members who are officials under the management of the Politburo and the Secretariat; reprimand and warn members of the Central Executive Committee for violating their political qualities, ideology, ethics, lifestyle, party activities, and performance of party member duties.

- Inspection committees from the district, county, and equivalent levels or higher decide on disciplinary measures for party members, but not party members at the same level; Decide to reprimand and warn party members who are cadres of the Party Committee at the same management level and directly subordinate Party Committee members.

- The superior party committee and inspection committee have the right to approve, change, or cancel disciplinary measures decided by the lower level.

- Party members holding multiple positions who are disciplined and dismissed will be removed from one or more positions, depending on the severity and nature of the violation.

2. Authority to discipline violating party organizations in Vietnam

The authority to discipline violating party organizations according to Article 37 of the Charter of the Communist Party of Vietnam 2011 is as follows:

- Higher Party Committees directly decide to reprimand and warn lower-level party organizations.

- Discipline for disbanding a party organization is directly proposed by the superior party committee, and decided by the superior party committee one level further. This decision must be reported to the immediate superior Party Committee and the Central Inspection Committee.

- Only dissolve a party organization when that organization commits one of the following cases:

++ Taking actions against the Party's guidelines and policies;

++ Extremely serious violations of party organization and activity principles or State laws.

3. Forms of discipline for violating party members and party organizations in Vietnam

Forms of discipline for party members and party organizations for violations according to Clause 2, Article 35 of the Charter of the Communist Party of Vietnam 2011 are as follows:

- For party organizations: reprimand, warning, dissolution;

- For official party members: reprimand, warning, dismissal, expulsion;

- For reserve party members: reprimand and warning.
