Are officials and public employees disciplined by the Communist Party of Vietnam affected in their classification?

Criteria for classifying an official as not completing tasks are stipulated in Article 11 of Decree 90/2020/ND-CP as follows:

1. Officials not holding leadership or management positions with any of the following criteria shall be rated at the level of not completing the task:

a) Showing signs of ideological, ethical, lifestyle degradation, self-evolving, self-transformation as assessed by the competent authority;

2. Officials holding leadership or management positions with any of the following criteria shall be rated at the level of not completing the task:

a) Showing signs of ideological, ethical, lifestyle degradation, self-evolving, self-transformation as assessed by the competent authority;

....

For officials and public employees, it is similar; if there are signs of ideological degradation, they are rated at the level of not completing the task.

Signs of ideological degradation are clearly stated in Section II of Resolution 04-NQ/TW 2016, including "not strictly adhering to the organizational principles of the Communist Party of Vietnam," and when Communist Party of Vietnam members violate, they will be disciplined according to Articles 7 to 12 of Regulation 102-QD/TW 2017.

Therefore, if Communist Party of Vietnam members who are officials and public employees have been disciplined for violations as stipulated from Articles 7 to 12 of Regulation 102-QD/TW 2017 (i.e., showing signs of ideological degradation), they are rated at the level of not completing the task. (In this case, it is necessary to accurately determine the violation that has been disciplined to decide whether the rating is appropriate or not)

Additionally, according to the provisions of point a clause 1 Article 3 of Decree 90/2020/ND-CP, one of the criteria for assessing and rating officials and public employees is to comply with the guidelines and policies of the Communist Party of Vietnam, the laws of the State, and the organizational principles and discipline of the Communist Party of Vietnam, especially the principles of democratic centralism, self-criticism, and criticism.

Furthermore, an indispensable task in the procedure for assessing and rating the quality of officials and public employees is to collect feedback and evaluation from the party committee at the same level where the official works; or the party committee of the agency, organization, or unit where the official works; or the party committee of the unit where the public employee works. Therefore, if Communist Party of Vietnam members who are officials and public employees have been disciplined from Articles 13 to 34 of Regulation 102-QD/TW 2017 (i.e., violations of State policies and laws), the party committee can base their evaluations and feedback on this.

The final assessment result is aggregated from all feedback and evaluations in the assessment procedure, including the evaluation of the party committee. Thus, the disciplining of officials and public employees by the Communist Party of Vietnam will affect their annual rating, with the most significant impact being rated at the level of not completing the task.
