1. Are fireworks allowed in Ho Chi Minh City on Independence Day, September 2?

Pursuant to Article 11 of Decree 137/2020/ND-CP, cases in which fireworks are allowed include:

- Lunar New Year

+ Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;

+ Time: Lunar New Year’s Eve.

- Hung Kings Commemoration Day

+ Phu Tho Province may fire short-range fireworks for no longer than 15 minutes at Hung’s King Temple;

+ Time: 9 p.m. of March 9 of lunar calendar.

- Independence Day

+ Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;

+ Time: 9 p.m. of September 2.

- Dien Bien Phu Victory Anniversary

+ Dien Bien Phu Province may fire short-range fireworks for no longer than 15 minutes at Dien Bien Phu City;

+ Time: 9 p.m. of May 7.

- Liberation Day (April 30 of calendar year)

+ Hanoi City and Ho Chi Min City may fire high-range and short-range fireworks for no longer than 15 minutes;

+ Time: 9 p.m. of April 30.

- Anniversary for liberation or establishment of provinces and central-affiliated cities.

+ Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;

+ Time: 9 p.m. of liberation or establishment day of provinces and central-affiliated cities.

- National or international cultural, tourism and sports events.

Thus, according to the above regulations, fireworks are allowed in Ho Chi Minh City on Independence Day, September 2.

Ho Chi Minh City is allowed to display high-range and short-range fireworks for no longer than 15 minutes

Fireworks display time is at 9pm on September 2, 2023.

2. Entitlement for allowing firing of fireworks on Independence Day, September 2nd in Vietnam

Entitlement for allowing firing of fireworks on Independence Day, September 2nd in Vietnam is specified in Clause 1, Article 12 of Decree 137/2020/ND-CP as follows:

Cases where fireworks are allowed:

- Lunar New Year.

- Hung Kings Commemoration Day (March 10 of the lunar calendar).

- Independence Day (September 2).

- Dien Bien Phu Victory Anniversary

- Liberation Day (April 30 of calendar year)

- Anniversary for liberation or establishment of provinces and central-affiliated cities.

Shall be decided by People’s Committees of provinces or central-affiliated cities on the basis of practical conditions of local administrative divisions and implemented on the basis of cooperation with Ministry of Culture, Sports and Tourism as per the law.

3. What are principles in managing and using fireworks on September 2, 2023?

According to Article 4 of Decree 137/2020/ND-CP, principles in managing and using pyrotechnics and pyrotechnic compositions are as follows:

- Complying with Constitutions and regulations and law of Socialist Republic of Vietnam.

- Ensuring that management and use of consumer fireworks, fireworks and pyrotechnic compositions is for the right purposes, compliant with regulations and law and environmentally friendly.

- Ensuring eligibility of individuals managing and using consumer fireworks, fireworks and pyrotechnic compositions as per the law.

- Reporting to competent authorities if consumer fireworks, fireworks, pyrotechnic compositions or if the license is missing.

- Disposing consumer fireworks, fireworks and pyrotechnic compositions that are no longer required, expire or cannot be used as per the law.

- Ensuring adequate procedures, safety and environmental protection when disposing pyrotechnics and pyrotechnic compositions as per the law.
